Sounds like they want to kill e-cigs, or at least any small business. The FDA part is big, too.

Lawmakers passed a crippling 40 percent tax on e-cigarette and vaping liquid inventories, retroactive to Oct. 1, which has small business operators fuming and on the verge of losing their livelihoods.
According to some estimates, 92 percent of Pennsylvania’s 300 vape shops could close as a result of the 40 percent wholesale tax and new federal regulations that require shop owners to pay for FDA approval for homemade vaping liquids. FDA application costs could top $100,000.

“The state has also added a possible 5- year prison term and $5,000 fine for those who try to buy the products off the internet or from out of state without paying the tax so you can’t do that and our customers are telling us that they’re scared that they won’t be able to afford the products

“There’s not only the tax coming on Oct. 1, but a floor tax as well that means all inventory owned by vapor companies will also be taxed at 40 percent which will really cause problems

In May, the FDA extended its authority to regulate all tobacco products including e-cigarettes, nicotine gels and hookahs. The agency noted that the changes were designed to improve public health and protect future generations from the dangers of tobacco.

Under the new regulations which take effect on Aug. 8, vape shops must register as tobacco manufacturers. The new rules include requiring all products, like e-cigarettes and vaping liquids, to be approved by the FDA prior to going on shelves.

“We will have to go through the process of getting a retail and manufacturing license which aren’t available yet from the state and, even though the FDA deadline is Aug. 8, we can’t get them until mid-September so it’s a Catch-22

The FDA rule is probably going to be very expensive and will probably end any small business vape liquid production.

The state didn't add the prison sentence/fine for e-cigs. It's been around since 2009. If you buy cigarettes out of state, you're supposed to fill out a form and submit it to the state and pay the tax.

lol... PA still doesn't consider cigars tobacco (which are made out of what... 100% tobacco) ... but somehow vapes are (despite being made out of 0% tobacco)...

LOL I just looked it up, buying vape juice in PA carries a greater penalty than a felony hit and run causing serious injury in CA.

Unreal, now the state will force 1,500 people into looking for a new job or collecting unemployment. Even shittier to read it's the Democratic party in bed with Big Pharma and Big tobacco, Big Pharma spent billions to develop smoking-cessation drugs, nicotine inhalers, lozenges, and vaping was/is taking a huge chunk of that market. One thing politicians are not realizing are vaper's become political animals very quickly when their right to enjoy vaping is taken away. Clearly the recent FDA regulations are pro big pharma, pro big tobacco, we WON'T forget who did this, I'd rather vote for a whack-job then another Democrat.

you know whats funny? the Weed tax here in colorado is putting MILLIONS into our schools.

as far as the OP and the topic, its nothing but a tool to keep the money flowing because of all people not paying the tobacco tax. the state is losing money and want keep the control.

honestly people are just going to buy the raw ingredients and make their own juice or like others have said just switch to the black market.

What I hate is the whole idea of taxing specific things, that's just a logistical nightmare for businesses. There is already like 15% sales tax on everything, is that not enough?
