I sold on e.bay 21" monitor. it was brand new sealed refurbished nokia with shipping $500. I sent monitor insured to e.bayer 2nd air promptly. He got it and few days later he sent me e-mail saying he got it damaged, I dont believe him cause it was 4 times bubble wrapped and in double box. We used billpoint as payment method. He said he called UPS and they asked how it was packed and he told them how and they said it was improperly package they automatically cancelled insurance claim. ( i didnt pack it, nokia did). They also said they will pick it up from him and deliver it to me. ( also in auction I specified no refunds or exchanges)now the monitor is lost somewhere in UPS might get to me by end of the month and he said he stopped payment on his visa card for billpoint. According to billpoint they will take away all money and $10 fee if he stops payment. I went back to billpoint and changed my info to fake and changed my cc and checking account, but i am afraid they will take it out from account they put it in. Can they take money out of my checking account without my permission? I am so scared and i even want to empty my checking account. Please give me your opinion and what should I do.

Play this straight. You are not in the wrong (aside from changing that info). If Nokia didn't package it properly, then it's their fault. You need to do this as logically as possible. Explain to the guy there were no refunds. If there's a problem with the monitor, it's Nokia's problem now. If it was damaged in shipping, it's UPS's problem. I don't *think* this is your problem. However, I really wonder how you know it was "4 times bubble wrapped and in double box" if it was unopened and sealed. Interesting, no?


Anyways, play it straight and honestly. That's the only way to go through life.

Agreed, you're destroying any shot that you would have at a legitimate case by changing your info and doing other similar things. Play it straight or this could bite you very hard.

Well it could be your fault if Nokia packaged it bad and you sent a badly packaged product to that guy. Who ever said that Nokia packed items that are in UPS standard

but problem is guy didn't contact me or anything when he got it. monitor was insured for $700 bux, if he would send me e-mail saying he got it damaged, I would ask him to send it back to me and soon as I get it, I would refund his money.( I would file damage claim and get my money from UPS for 100%) but he took matter in his own hands stoped payment right away, didnt shiped it back to me , he refused package and ups returned it to me and it got lost or something cause its been two weeks since they picked it up from him. now i will have broken monitor and that i can't do nothing with it, because of his call i cant claim insurance and addition to that soon as his credit card wins disputing with billpoint , I will be at loss $510 bux and its big money to me as college student.

Actually he did the same thing I would have done, except maybe the stop payment. I'd never accept a damaged shipment and you should take it up with ups when they try to deliver it

I usually never had problems with UPS when package got lost. (i never had package that was damaged in transit in my 3year experience of shipping by different carriers) i am totally lost and that guy is horrible because he doesnt want to communicate to work things out. he simply cancelled payment instantly and he doesnt care that i wont get insurance because of him. he simply said sorry man.

I already spoke with UPS and called claiming department supervisor. He told them it was packaged badly and they put it on file that shipment was damaged because improper packaging. If he would return it to me I would file claim and get my claim paid but guy screwed me up

what a bummer, i don't think they can withdraw from your account but they may think that you are involved in fraud and freeze your account, esp. b/c you changed all the info. Unfortantely you have no proof it was packaged correctly, etc. I hope this works out for you. Best thing IMO is to come clean, and consider it a lesson learned. Sounds like you are getting shafted, unfortantely.


So much fraud happens on online auctions it's rediculous, although this is the first time I heard about from the seller's side. If e-bay.com actually had to be somewhat responsible for the massive amount of fraud resulting from their auctions, they'd go under tomorrow. Instead the FTC pays for the stupid online auctions by investigating thousands of claims of online fraud relating to auctions. Federally subsidized private websites, what next?

I think that once UPS agrees to ship the thing, they are taking on all responsibility. Therefore, if the thing passes the inspection when you bring it in to ship, then they have to pay the insurance if it is damaged during shipping.

Believe me, some of them have done some major inspection of the packages that i have been sending :p

I'd think if you talk with ups you could resolve it, just because the other person said it was packaged poorly doesnt mean anything, I'd make the local manager inspect it and inspect it yourself. If its double boxed with buble wrap and a huge puncture through the side of it, or crushed I doubt they'd argue. May I also remocmmend you take pictures and consider refusing delivery yourself unless you get a manager to see it? In that thread in fs/ft you asked about moving money from one checking account to another, may I recommend you not try to clean out the account in question if thats what you were thinking of doing.

I don't have negative feedback on e.bay or anywhere all of my transactions were positive and always worked things out and sometimes when it was my fault i offered money back or gifts or even next day air replacements. this guy even didn't leave me negative feedback. i will withdraw money from my checking account will wait to see what happens within next 60days, If billpoint contacts me i have proof that i shipped his monitor on time and insured and that he received it, plus even on billpoint invoice that e.bayer paid i put in return policy space no refunds or exchanges. all sales are final for this auction. He didn't shipped it back to me insured, he refused it, I still have not received it and let billpoint take it up with his credit card.

He got a damaged monitor thoug, thats not a refund of excahnge, he didnt get the functioning monitor he ordered. I would have refused it too, just remember that I think most people would.

hey I have no proof it was damaged. When it left me it was in excellent condition, maybe he changed his mind or wants to buy different monitor. until i get monitor into my possesion i dont know for sure if it's damaged or not.

Good News!

His credit card didn't win the dispute against billpoint. He is pissed that credit card didn't win, he took the monitor to his local UPS facility they photographed damages for their insurance company sending me the monitor and paper works. All now he is asking as soon I get a check from UPS to send him the total from insurance. That's the right way to handle the situation and not by stoping payment. I will be more than happy to send him refund soon as UPS pays out the claim
