Opened a Brand New (Sealed) Video Game and there was no disc inside

Update (March 15, 2008)

I just picked up my mail and there was a package from Ubisoft. Inside was the game case that I sent them (empty) along with a shiny new Assassin's Creed DVD. I now love Ubisoft.

This is freaking BS!

I bought Assassin's Creed right after Christmas when Best Buy had one of the $40 sales. Being the busy professional/husband/dad that I am I hadn't gotten around to playing it, or even opening it. Yes, the game has been sitting in my entertainment center for a month and a half sealed (I doubt I am the only adult who does this occasionally). I finally decided to open it to play it tonight and THERE IS NO DISC IN THE CASE!

The game appeared to be completely sealed. It was wrapped in plastic and had a sticker on the top. The instructions are still there.


What the hell do I do now? I doubt anyone from best buy or Ubisoft will believe me,
especially since I bought it in December and just now opened it. I sent Ubisoft a support request just now, so I should hear back from them tomorrow.

For those of you that bought Assassin's Creed, do you remember if there was a sticker on both the top and bottom of the game case? This one definitely only had the sticker on the top. With all of the stories about people buying things at BB that contain rocks or something else inside I wonder if someone was able to fit the disc out without damaging the seal enough for anyone else to notice.

Don't bother going back to best buy, they'll accuse you of fraud

Call your CC company. If that doesn't work you're screwed.

Shit there's no harm in trying. I mean if you look like a decent enough fella they may allow you to return it. Or hell pull a fraud on them, try and re-seal it and return it :p

They'll accuse you of stealing if you try that shit at a store. So if you're prepared to take that kind of abuse knock yourself out.

buy another one with your credit card. return the new sealed one using your gift card receipt. dispute the charge on your CC

Even if BB believes you, and it won't, the time period elapsed kills your chances with BB. Good luck with Ubisoft.

Does the game have multiplayer that you care about? If not, you shouldn't have any problem finding and downloading the game on a torrent. Why not - you paid for it legally.

I did this once with BF2 when I got a defective disc. I downloaded the game to practice single player before I could make it back to the store to exchange it.

All 360 games get shipped with a Microsoft COA printed on one of those case stickers, however it's on the right side (exactly opposite the case binding) holding the case shut.

next time...you'll probably open your purchases just to inspect them. I know I now will....

Ask the software company. They're just selling you a license. In theory, they should be able to send you another disc, assuming they care about customer service.

Just tell the makers you have a cd key, and that you need a replacement cd/dvd etc.

This is for the 360. The physical disc is required.

I've had that happen one time a LONG time ago when I got wordperfect at sam's club. This was back when they took in returns on software and apparently someone didn't check the box -- nothing there. I checked when I got to the car since I did not hear anything rattling so I opened it up. Only the manuals.

They got a little huffy about it but we had bought a good deal there for a few years and the mgr didn't make much of a problem of it.

Now another time I picked up a creative cd-rom drive at a walmart near here, shrinkwrapped and all -- inside was a pottery bowl. About the same weight and size.

No problem from them at all, the mgr did take me aside and ask a few questions but I got it exchanged on the spot.

something similar happened to me a long time ago at compusa. bought a sound card there, it was packaged new. Installed it and it was dead. tried to take it back the next day, they said the serial numbers didnt match and tried to accuse me of fraud. Those a*holes repackaged that thing and tried to sell it as new. That was the last time i bought anything from that place again. I think they are bankrupt now. i'm glad

Buy a new one, open it, take it back inside without the disk, return it, etc. Since they sold you something that wasn't there, I'd feel no remorse over doing it.

My dad bought a what was supposed to be a new in box harddrive from Best Buy. Brought it home and it was a broken harddrive of a different kind. He took it back to the store and got an exchange no problem. I was very surprised at that, so I would suggest to try and get an exchange.

EDIT: Well, if they ask about the time delay, say that you bought it as a gift.

The product process manager at my local Bestbuy re-wraps returned items to be sold as new whenever possible so they don't take the margin hit from selling it open box.

to Xed, BB doesn't take software back unless it's defective, even then it's a hassle. If somebody had returned a bad copy it would have never gotten resold. And I've never seen a BB that re shrink wraps stuff, they just put an open box sticker and sell it.

Sucks what happened to the op, and I'm sure this happens from time to time, hell it could have been the fault of the manafacturing plant. But anyone who expects any company to give a person another copy who comes in saying "I bought this and there was no disc inside" is dumb, sorry.
