Yes, it refers to the license. The fact that it isn't easily understood helps make it non-free. The license also delves into patent stuff, which is a bad thing.

If you do a search on misc@openbsd mailing list, you should see a lot of discussion about the license changes. Theo is one of those people that's kind of strict about those things. ;)

The only real problem that I have have with OpenBSD is that sometimes it doesnt detect hdd sizes correctly . It tends to be on those cheap ass celeron boxes though and older pre piii boxes

There is a note about that in the FAQ. I haven't had an issue with that with any of my systems (except an unstable Ultra 10), especially the SCSI systems. ;)
