Open Liquor laws in a car

I thought that in Illinois, having less than 6 out of 6 in a sixpack is illegal. ie if I had a six pack at my house, drank 2, then the next day/week/whatever, drove with it (the remaining 4 out of 6) to a friends house. No open bottles in the car, but since the six pack isn't complete, is it still against the law?

Even if it is illegal, I strongly doubt you will be cited for having 4 of 6 beer cans in a six packs. The only real reason you would ever be cited for a container violation would be if it was pretty blatant or the cop REALLY wanted to be an ass.

Oh I understand that completely. Me and another person were just curious if it was in fact illegal, despite the fact that its probably rarely enforced.

I know cops can be db's, but they'd have to be mega-douches to try and cite you for 4 cans of beer in your trunk.

Technically, illegal. The seal is broken, even if the beer is still in the can/bottle whatever. Would I cite you for it? If you are being an ass...sure. If not...have a good night :)

Never underestimate the stupidity of liquor laws. I was once the passenger when pulled over after going grocery shopping with my brother, 23, when I was 19. The officer informed me I was lucky to not get an MIP because the 12-pack of beer my brother had bought was under my legs, therefore in my possession. So mothers, be careful with your children, if you put the beer on their side of the car they just may get an MIP too.

If that's how the law is written, I doubt the intent is removing 2 cans from a six pack; they mean the seal on the can or bottle.

no its not illegal. they are not breaking the seal of the can/bottle. they are taking them out of the package. there is a huge difference.

What is legal or not doesn't affect the net result of a bad encounter. I once was stopped and the officer reached through the window, took a bottle from the six pack in the rear seat, threw the bottle into the ditch and said "looks like you been drinking, Son!"
