So, our A/C was on the fritz yesterday and driving us nuts. We started combing through the lease looking for the emergency maintenance phone number and my wife came across this little tidbit:

Death of Sole Resident. If you are the sole resident, upon your death you may terminate the Lease Contract without penalty with at least 30 days written notice. You will be liable for payment of rent until the latter of: (1) the termination date, or (2) until all possessions in the apartment are removed. You will be liable for all rent, charges, and damages to the apartment until it is vacated, and any removal and storage costs.

Not only is the stupidity of the clause ridiculous, they can't even make it grammatically correct. Look at all of those misplaced commas!

I guess they'd have a claim to the money from your estate and written notice would come from relatives/friends.

This, except the notice would need to come from the executor of the estate.

Also, doesn't Texas mandate that the lease use language approved by the legislature? that's probably why it's grammatically incorrect, it was written by committee.

They're saying that if you die your estate will be required to cover the costs of rent until your posessions are removed from the unit. As with many prior obligations, just because you're dead it doesn't mean you're cleared of your liabilities.

And yeah... grammar... politicians... lawyers... 'nuff said.

While I understand and agree on the intent, it is not worded in such a manner that your estate or the executor of your estate has any legal rights.

It is only a binding contract between two parties without any mention of anyone with power of attorney and as such, once you are dead, so is the agreement.
