Ongoing problems with a debit card stolen in May.

I got my debit card stolen in the beginning of this past may. As soon as I found out I canceled the card, got a new one, and signed an affidavit from Wachovia stating that the charges after 05/XX/09 were fraudulent. I put a fraud alert on my credit file just in case, just to make sure that it was just my card and not my identity that was stolen.

There have been no calls or emails about any fraud, no other problems that I was aware of.

However, a few days ago I received a bill from a company called "Preferred Platinum Plan" for $156.02. I did a little Googling and found out that it's a business that provides billing services for phone sex hot lines. The call was from the number (661) 298-0913 for a 16-minute phone call made on 6/4. The problem with this is that I live in Pennsylvania, and my number has a 215 area code. I haven't been out of state in months. Also, the my old stolen card was canceled on 5/23.

I called the company up and told them my situation, and what had happened. They played a recording of the call... the dude sounded nothing like me, and he gave his birthday as 12/1/83. My real birthday is 2/20/89.

I told the lady all of this and all she kept asking me was, "How would you like to take care of this bill?" I told her that I would like it gone, seeing as how I didn't make the purchase, and that the person who did used a stolen card. She told me that she was sending me an affidavit in the mail, which I would need to sign and return along with a police report. When they received that, they would "investigate the claim further".

I looked into the company a little further and found a lot of complaints regarding their business practices. Apparently, they don't check to see if a card will go through before they start the phone sessions. They simply take your number down and send you a bill later if the card doesn't get approved.

All I can say now is... FUCK. THIS. SHIT. This is really starting to piss me off.

Does anyone feel like doing a little detective work for me, perhaps finding out who the number that the call was made from belongs to? I know it's a long shot, but maybe someone has some special ways and means that I don't. :)

EDIT: Found out where the dude who placed the call lives! Did a little snooping with his phone number and found his full name and address. Where should I go from here?

Could you really be randomly billed like that? Throw the bill away and forget about it? What can they do?

They have my address and phone number. I guess I could technically tell them to kindly go fuck themselves and ignore them from now on, but I don't want this stupid-ass shit haunting me down the road.

The charge wasn't made until 6/4, and I called Wachovia to cancel my card and file a claim on 5/23. The charge hadn't even been made when I originally called Wachovia.

Don't pay it. I can send you 10 bills a day. It doesn't mean that you have to pay them.

So basically your wife saw the bill to that transsexual hotline you called while she was out of town, and this is a big show so she doesnt find out you arent exactly "vegetarian." ?

Alright, so I have an idea of how to mess with the guy who made the call.

I'm planning on copying the bill, changing the information to reflect his own, and mailing it to him with a note saying something along the lines of, "You know, you should really pay for your own phone sex."

Pretty much harmless, doesn't seem illegal in any way that I can see. What do you all think? Yay? Nay?

My twin brother got some charges from a (probably fake) company that supposedly collects for adult websites. Dunno how they get the card number to initiate the first charge, but I think they are hoping that you call and give them your other personal info in order to remove the charges (my brother refused) or will allow it because it beats calling the bank and sounding like one of those guys that wants to hide his porn purchase from his wife. It's bullshit.

Bump for the Wednesday morning crowd and ATOT legal folk:

Can this company REALLY force me to pay the charges? They're making a pretty huge deal out of this whole thing, especially considering the charges were made to a CANCELED card. IMO, it's THEIR fault, seeing as how they billed me for the charges without checking to see if the card was legit or not. I'm half tempted to just ignore them... but I'm afraid that this will come back to haunt me down the road. Is that possible?

The thing is though, they have my name, address, and phone number. There's no other personal info to collect which makes me thing the charges are somewhat legit.

Maybe your bank can help if you give them a call.
I don't know what that company can do with just your name, address, and phone number. Sounds like their msitake and their problem, I would ignore them.
