so my manager said today until menopause, female employees are exempt from the preparation of chemotherapy drugs; which i asked 'then how come female employees @ the nuclear medicine dept are not exempt from their jobs until they are pregnant (and bring in a doctor's note)....are you saying females ages from 14 to 40's are exempt from the job requirement? she said why don't i check with OSHA,

any suggestions on how to approach this?
a) HR?
b) department of labor?

or just tell her i'm having a lunch date with my ovulating wife and therefore have to keep my boys fresh and therefore cannot perform said assingment
 
My understanding is it's the cytotoxicity in chemo drugs that attack fast growing cells, thus the risk of birth defects in developing fetus.
 
Go to HR, but you better have all your ducks in order.

Ie. Understanding the health issues. Making a fool of yourself will not endear you to your manager or HR.

Also the manager did not make such a decision on her own; she received a directive from higher up.

yes, congrats all around when the female employee has conceived, but prior that what
right does having a uterous lessens the entitlement of male employees' reproductive right? (this refers to both married and non married men)

females already number 5/9 in the department, with 4 out of 5 in the 'if she bleeds, she breeds" exemption....this hegemon of sisterhood meant the males have to be exposed more frequently, due to a smaller assignment rotation pool.

Perhaps the female manager is protective of her gender, periodically declaring to the male staff the way to a peaceful marriage is to treat the wife like a princess, which in her fantasy means having the wife stay home instead of forcing them to be employ full time (not possible with mortgage in NYC) and prepare chemo.....this policy is what she expects from chilvaous men because she herself slogs to work every morning before 7 to argue with people like me 🙂

thanks for the UAW v. Johnson Controls info, my understanding is the courts does not want a corporation to impose overprotection of the fertile (to prevent lawsuits from malformed children?) or force employees to choose between making a living or having kids.....is that correct?
one particular employee is hyperparanoid (super religious and in her 40's) about chemo preparation but can't explain any further difference between preparing a regular intravenous bag vs a chemo except the protective gowning/facemasking/double gloving.....so if management agree the protection is inadequate, wouldn't it be inadequate for all other employees? it's not like handling nuclear material forchirstsake!
or perhaps her phobia is what gave her the medical excuse to be exempt...another one via the grapevine i heard ememption was due to stress related irritable bowel syndrome
(and promoted to a special desk job).....oh btw this is a union job
