Todd Man Can't Breathe...OH NO

I'm on the fence as to whether they actually should have charged the guy. The thing is, the victim is apparently pretty crippled from the incident, so I guess he does need to be severely punished.

This can't lead to jail time, can it? Oh, but most of you guys know nothing about Canadian law. If he was charged with "assault causing bodily harm" in the USA could he be jailed?
