I don't see anyone getting kicked in the video. When does it happen?

That was an old video. You can see his hand around the convicts throat.
Is that harassment?

Kicked two restrained suspects and then lied about the circumstances. Yeah, I would say five years was a fine sentence.

The guy wasn't handcuffed yet, so i don't see anything wrong if he did something wrong.

He's also small. 5ft 6in.

Probably had Napoleon complex. His 3 brothers and father are police officers.

I heard that his father would play a game with fellow officers. They would throw you off the wall and whoever bounced their convict the furthest won the game.

This was in the 1960-80's.

5 years? Sounds a tad harsh since there was no permanent damage or anything, but I wouldn't say 3 years would be out of the question. Didn't go through links for this info, but I'm guessing eligible for parole in 2-3 years? If so, sounds reasonable to me.

He deserved to lose. His position is one of extreme authority; he is supposed to be the person upholding the law, not breaking it. If a regular citizen had a couple of people handcuffed, then kicked them in the face, they'd get a much worse punishment for illegally detaining / restraining prior to the kick. His authority was used to permit him to detain them legally, but then he played off his permitted legal actions to perform an illegal one that was nobody's fault but his own.

This is what should happen to cops that do things like this. Not crucifying them and sending them to jail for 50 years for getting pissed off and hitting someone, but just to have a level of accountability and repercussions similar to what a "normal citizen" would have, but more leeway in some circumstances due to the job they are performing and less in others. This is one of those instances where I think the cop should be held to a higher standard than the general public; I don't think it would be good for anyone if people starting resisting arrest just to avoid getting pot-shotted after they are detained.

I think the punishment is pretty close to fitting the crime here.

Sounds about right to me if what the story says is true and as long as all that stuff sticks.

Car theft suspects.

They were face down, on the ground, and cuffed.

Three other cops say they were completely subdued.

Three other cops say that there was no weapon present.

Read the articles and see if you can still defend this guy...


As for jail, I'm sure he's in PC and will get PC, if not even sent to a special facility.

Oh, and he's done 30 days. Has to do 370 more days before being eligible for parole.

I think this is fair.

I'm not defending the guy. I complaining about a video that I was lead to believe showed some kicking in it.

Yes. His father was pretty bad. I've heard some pretty awful stories. He abused his power and was able to get away with it. Back then, I'm sure there were a lot of bad cops.

Has anyone seen Serpico? Its a movie that shows the corruption within the NYPD, and it stars Al Pacino. Love that film.

We were old friends years ago. He was sentenced to 5 years for kicking two criminals in the face after they were subdued.

He lost his $70k job
He lost his pension
He lost everything!

Was 5 years really necessary? Criminals rape women and get 6 months.

let a cop kick you in the teeth while youre handcuffed/restrained and then see how you feel about this sentence. for every cop who did something like this and was convicted, there are a thousand cops that did something worse and got away with it. the fact that hes your friend doesnt isnt relevant, any more than if one of those prick burglars was your friend. if you read that article, he expressed no remorse, hes one of those cops that thinks hes a "goodguy" just by virtue of being a cop

5 years isn't long enough. I'd be content with 10.

Anyone who uses a position of power to delve out physical abuse should get mandatory 5 years on top of whatever other sentence.

I'm all for defending cops,.. especially when a cop does something bad, and then some asshat paints ALL cops as being just as bad.

But, this guy did something very wrong.

They were subdued. Your friend did his job. It's done. Great. No need or justification to take it further.
