In the state of CA, you can't lose your vacation days. The company either has to let you accumulate them, force you to take them, or pay you for them, but you can't lose them.
I don't think that's correct. I'm in CA, here's a quote from our employee handbook: "Unused vacation time will reduce your vacation award for the following year by the number of hours being carried over, so that your maximum vacation time does not exceed your annual award."
I'm pretty sure I'm correct. Your vacation time is hours you have worked for. They are compensation for the hours you have put in. The only way to know for sure would be to make a call to the State Labor Relations Board.
You're correct for Ontario, at least. Vacation is deducted from our biweekly pay. They can't take it away.. if you let it accumulate for a long time...at some point, they'll force us to take it.
