You're right to a point - insurers have actuarial tables to calculate the value of medical errors based on the injuries sustained - but I think this case is kind of an aberration, and there is no way of knowing what a jury might say due to the incredibly sensitive nature of the harm he suffered. I hate to say it, but I am not sure I would be able to live without genitals, and would definitely rather lose a limb than what he lost. I could imagine some major actual damages here, and his wife will probably be able to recover a meaningful amount for loss of consortium.

I agree, a JURY may award more, but a judge will either reduce it or the insurnace company will keep it in the courts so long the guy will either be dead or at least unable to really help in his own case.

But either way I would be VERY UNHAPPY also. Did anybody read all the other cass they listed. Like the woman that had both breat removed then they found out she also had NO cancer at ALL.

I would like to see a jury award the man the doctor's penis. Have it surgically removed then reattached on the 67 y/o...

Yet another reason I am unfit to be on a jury

Not necessarily - in many instances, when a jury awards a very generous verdict, the defendant will agree to settle for some lesser amount rather than prolonging litigation. Last year my mother presided over this case, where the plaintiff recovered the largest civil verdict ever awarded in Minnesota. The plaintiff was awarded $35.3 million in ACTUAL damages by the jury, and the defense agreed to settle once Mom ruled that the plaintiffs could go after punitive damages as well. It's a shame but it's probably better it happened to a 67 year old who has had a lot of sex in his life rather than a 20 year old horny bastard.... jeez.
