Off duty Texas cop shoots woman in the head during fit of road rage.

An off-duty Texas cop got upset at a woman for cutting him off and allegedly fired his gun into her window, hitting her in the head.

Now Precinct 6 Deputy Constable Kenneth Caplan is charged with aggravated assault with a deadly weapon, according to Click2Houston.

The woman, whose name was not released by the station, said the bullet grazed the left side of her head, allowing her to avoid a major injury.

"I feel like I got a taste of death, honestly," she told the station. "My heart was slowing down and I couldn't really breathe."

The incident took place on Nov. 11. The woman said Caplan cut her off so she did the same to him. That got him so upset, she said, that he pulled out his gun and fired into her vehicle.

Now, she tells KHOU, she's scared that, because Caplan is a police officer, she could be retaliated against.

"I keep thinking someone is going to come up and shoot me," she told KHOU.

Aggravated assault is considered a 1st degree felony whereas attempted murder is a 2nd degree felony. Based on this aggravated assault will have a larger penalty/sentence and adding the use of a deadly weapon will add more time on the sentence.

Ah good to know, so he is going to actually do some time over this. That's a step in the right direction.
 
Constable's are a joke.

are they less or more powerful than a regular county sheriff?

i only ask because there's one that lives on my street, he drives a blue durango with a lightbar on top, wondered if it's his personal car or if that is police issue suv, he wears a uniform that's different than a regular sheriff's too.. always wondered what was up with constables.
 
As far as Texas is concerned Constables are not much different that a police officer or sheriff.

haha of course Texas is the only place a constable is a real cop 🙂, good to know.
 
I somehow don't think he will be given a slap on the wrist or be able to return to duty. According to the local news he has been arrested and is still in jail on a $200,000 bond.

Just a note concerning the shooter's status. While it is appropriate to consider the shooter a sworn law enforcement officer, it would be more appropriate to consider him a 'Volunteer/Reserve' Officer.

Harris County Precinct 6

Volunteer/ Reserve Police Officers must complete the State approved Basic Peace Officer Certification course which is now over 600 hours. Most do this training at their own expense through The University of Houston, The Houston Community College System or at other area colleges. Several volunteer Deputies are retired police officers. Deputies at Precinct 6 are required to be bonded and put in 24 hours of service per month in addition to State required in-service classes. Deputies must pay for their own uniforms, weapon and leather gear. A benefit for these volunteers is the experience, free or low cost training and a chance to build a good resume while contributing to the community. Many volunteers move on to full time paid positions at area departments. Each team of Deputies are supervised by a Sergeant.
Pct 6 has released a statement disapproving of Caplan's actions.
It read, "Kenneth Caplan was not on duty at the time of the incident in which he was involved nor was he displaying any article connecting him to the Harris County Constable's Office - Precinct 6. The Harris County Constable's Office - Precinct 6 neither condones nor tolerates the actions taken by Kenneth Caplan that connected him to this incident, and the necessary measures were taken to collect his credentials and remove him from our status."
For 26 years, Precinct 6 Constables have been lead by Constable Victor Trevino an elected official.
A few weeks ago, Trevino plead guilty to a felony financial misconduct.

And oh, the road rage case isn't the only recent incident involving Precinct 6 'Volunteer/Reserve' Officers discharge of their weapons.

It's a good thing this was done by a cop, otherwise, I don't think none of you would have cared about this woman.

Must be nice to selectively preach respecting life and humanity,.. only when it serves the purpose of bashing/criticizing your enemy,... hm,.. I guess the popo is rubbing off rather nicely on some of you,..
