OEM Selling with used hardware ?OK

I have various older Windows OS and a few older Office applications, many of which were OEM. I see OEM at auction frequently with a piece of used hardware. But, is it legal and acceptable to resell this older software on AT Forum's "For Sale" thread with a piece of hardware, eg cable? The Operating Systems run from Windows 95 to Windows 2000 and the Office applications from 7.0b to 2000 versions. Thank you in advance. I don't want to get in trouble with the mods.

you ouwld have to read the agreements for each piece of software. some allow resales with hardware, others require the resale to be with the original hardware it came with, and some others do not allow any resales. Good luck to you.

I would say for Windows 95, even if it is OEM does not need a peice of hardware. Windows 95 is end of life by Microsoft.

Include an IDE or power cable and you'll be fine (on AnandTech).

The requirement that an OEM product be sold with a piece of hardware is not a legal requirement, but is a contractural requirement from MS to the retailer only.

For an end-user who has already bought the software at retail, this clause does not hold. You are perfectly entitled to sell 2nd hand software privately without any hardware.

If however, you obtained the software 'wholesale' - i.e. you were intending to sell it on, rather than use it for yourself then you may be required to follow the requirements for distribution.
