NewEgg.com says this drive has a 3-year manufacturer warranty, but they're out of stock at NewEgg.com. That probably means that all of these OEM drives from any site have the same, right?

I would say that's true, yeah. Most hard drive RMA's just want to know when it was bought more than whether it was OEM or retail...
<< If I buy an OEM Maxtor D740X 40GB (for $92 + s&h) from www.essencompu.com (or anywere for that matter), will it have any kind of warranty from Maxtor?
they use the word "OEM" for both OEM and bare drive.
if it's bare drive, you'd get same warranty as retail.
if it's real OEM drive such as for Dell, Gateway, you may not get any warranty from hd manufacturer.
those "OEM" drive sold by newegg such normal computer parts retailer is for sure the bare drive with 3 years warranty.
