OEM copy of Windows XP

I bought an Acer Aspire notebook and it came with an OEM copy of Windows XP Pro SP2. Is it legal to sell these oem copy's??? or will it only work on my Acer.
 
Actually, along the same lines. If I wanted to reformat my friend's laptop (which was preinstalled with WinXP home and has a serial key) can I just use my legit Windows XP Home CD and just type in the number underneath her laptop? Her problem was that she lost the original recovery disk.

It would have to be an OEM disk.

unless you're selling the laptop with it
 
Unless you received a sealed OEM OPK, and are planning on selling it the same way, then no, you would have to sell it with the original system. Of course, MS will say you cannot transfer the license, and that the recipient of the laptop would have to purchase their own license.
