they've been telling us for almost 3 months now that current owners with the newer Indilinx drive(using 34nm nand) will have the option availble once the other partners(vendors) have implemented it. Makes me wonder how well it will sell in a market that is becoming increasingly saturated with more models. Many of which are faster than this one.
Easy way to tell if you are able to update when it's finally released to the general public is to remember what firmware came on you drive from the factory. They changed to 34nm at about 1.3-1.4 firmware revision.
Otherwise you need to run the Indilinx identity tool to know the ID/exe number of the drive to see whether it's 50nm or 34nm. Only the 50nm will be excluded. It's just the opposite of the available Turbo upgrade where only the early drives could use that firmware. That's good for my 9 newer drives though as they were all 1.4 firmware when new.

PS.. almost forgot to mention that the new drives are available now.. so it really shouldn't be too much longer for the release to existing owners with 34nm drives.
