There seems to be a new firmware that brings the return rate down to normal levels.
I picked one up. I'm not a spaz when it comes to return rates. For 60 bucks I'll take a 1 in 15 chance, especially if it goes down to 1% with the new firmwares.
Have used an agility 3 120gb drive in my laptop for about 8 months now. Have had no issues. I would recommend them, and at that price its a small investment (I paid around $130 for my drive which I thought was still pretty good).
Make sure you have the latest firmware and do a clean install of windows. Use intel sata ports over any other controller and make sure your motherboard also has the latest bios just to avoid issues.
I've got an 60GB Agility3, it's been pretty much trouble-free since December. My biggest complain is it's too small.
Since OCZ has come out with the Agility- and Vertex4's, the prices on the Agility3 has really come down. I had my mind set on a Plextor M3, but the prices I'm seeing on the Agility's are almost .50/GB... that's pretty stiff competition.
Like I said, I run an OCZ agility 3 120 in my laptop and in my primary desktop I run 2x 120gb vertex 3s in raid and have never had any issues. Obviously not everyone regrets it.
I would say that if you're using unusual (weird chipsets and etc) or outdated hardware of any sort, you may want to stick to Intel and Samsung and etc, but if you are using modern hardware that is well maintained you'll probably be fine with OCZ.
And I'm not OCZ fanboy either. Prior to my vertex 3s I owned 2 intel X-25ms, and have bought for my girlfriends various computers 2 corsair nova drive and a corsair force gt drive. My general philosophy is if the price is right buy it as long as its a large reputable company that offers frequent updates to its products.
