Yes you can burn up a chip if you OC too much. You need to check the bridges to see if it's locked or not. Many of the new Birds are coming unlocked from the factory.
 
OC'ing won't necessarily kill your chip, but it most likely will shorten it's lifespan...although how significantly is anyone's guess. as long as your OC smart (i.e. slowly increase to a stable and faster speed, and also make sure you have a good heatsink / fan combo) you should not really harm your chip
