i informed my boss, who i have a pretty good relationship with, about a suspect high vacation balance.

direct boss said "check with payroll. if they think you have xy days then you have xy days, i dont care".

i emailed payroll for confirmation, and i have it on e-paper/document that they think i have 13 spare days left.

so manually backtracked my hours for 2009, and discovered:

-i used 9 days of vacation not docked from payroll
-i used 5 days of unpaid leave, which i was paid for (so essentially +5 days of vacation)

basically i took 14 free days that are not accounted for.

should i reveal this information to him? hes cool with me on a personal level. but it would be disingenuous for me to KNOWingly take advantage of the situation. plus, everyone in the office knows i went nuts with vacation this spring, so if i take 2 more weeks off it'll look really bad...

Well, he did already tell you that whatever payroll had you down for he was cool with. I wouldn't run out and use all your vacation now; save it, use it down the road. Or, if you feel guilty about "stealing from the company" (which is a fucking ridiculous idea when it comes to time by the way), tell your boss, who may well say, "well, I guess you got 13 days of vacation left."

Exactly. You were straight up with him, and he probably appreciated it. I would probably take him out to lunch or something.

Your boss probably doesn't have the authority to "not care" here. That is, it's not his issue to care or not care about, it's HR's issue. If they find out later that you knew they gave you extra days (because you told your boss about it) but didn't try to correct the situation, it could hurt you.

I'm assuming when you e-mailed payroll you said something like "Could you verify how many vacation days I have left?" as opposed to "You forgot to deduct the 14 vacation days that I took this year - could you fix on that?"

"I had taken a mixture of personal days, vacations, and absent-leaves earlier this year. I have not taken a day off in over a month, so I expect that the vacation balances shown on payslip is correct. Can you confirm that the hours shown for me are accurate and up-to-date?"

i didnt "investigate" the situation for correct figures until right now

Don't worry, they'll deduct the money from your future paychecks once they do a balance and find out they made a mistake.

LMAO ... he's notified them through all proper channels. Their record keeping failure doesn't make him a criminal!

I'd ask them again ... maybe they know something you don't ...

Your boss my be fine with it, but if you have a payroll department, then it is their final say. Tell them about it, because at some point they will find out and you won't get something for nothing. You'll either be docked the time off, or they will take it out of your pay at the most in-opportune time.

I'm in HR -- tell your payroll department. It's probably not your boss' call. If they find out later, they'll (probably) still take it away from you.

*Payroll deposits $100k into my account*

Me: Hey boss, looks like payroll deposited $100k into my account on accident
Boss: Check with payroll. If they think you earned $100k then you have $100k, i dont care

Vacation days are same as cash. You get paid on them upon termination.

Absolutely incorrect. Unless this is a small company, it's not the boss's call.

I can guarantee that it will get picked up eventually.

Vacation is tricky. If his boss didn't forward the vacation request or if it wasn't entered and they just took the vaca then it's as if he just showed up for work.
