NEW YORK (Reuters) - U.S. Representative Michael Grimm of New York said he would not resign from Congress following his guilty plea on Tuesday to a federal felony tax charge.

"As long as I'm able to serve, I'm going to," said Grimm, who noted he easily won a third term in November despite a 20-count federal indictment unveiled in April.

Grimm, a Republican, pleaded guilty in Brooklyn federal court to aiding the preparation of a false tax return in connection with a health food restaurant, Healthalicious, that he co-owned before his political career.

"While operating a restaurant, we underestimated the gross receipts and used some of the money to pay employees off the books and some other expenses," Grimm said in court.

As part of a plea deal, Grimm, whose trial had been scheduled for February, also signed a statement of facts, admitting to concealing over $900,000 in gross receipts from 2007 to 2010 and lying during a 2013 deposition.

Grimm's defiant declaration that he will not resign could put U.S. House of Representatives Speaker John Boehner and other Republican leaders in a difficult position as Democratic members have already begun calling for Grimm's resignation.

"Clearly, Speaker Boehner must insist that Congressman Grimm resign immediately,” said House Democratic leader Nancy Pelosi in a statement from her home earlier on Tuesday.

A Boehner spokesman said he would not comment until he has discussed the issue with Grimm. Grimm told reporters he has had "private discussions" with leadership but would not elaborate.

The 44-year-old former Marine and FBI agent, who represents Staten Island and parts of Brooklyn in New York City, faces a maximum of three years in prison when he is sentenced on June 8. His lawyers indicated they would seek a more lenient sentence.

Grimm told reporters he was accepting responsibility for a "mistake" that occurred before he joined Congress.

"For the past four years, I've been a very effective, strong member of Congress," he said, adding that he had received many words of support from his constituents.

House members who plead guilty to a crime that carries two or more years in prison "should" refrain from voting on the floor or participating in committee business, according to House rules.

The House could also vote to reprimand, censure or even expel Grimm, as it did in the case of Democratic Representative James Traficant, who was found guilty of taking bribes and other crimes in 2002 but refused to resign.

Prosecutors had accused Grimm of hiring illegal immigrants, paying staffers under the table and under-reporting how much he spent in wages.

He was also charged with lying under oath about his practices while defending against a lawsuit brought by former Healthalicious employees.

The indictment grew out of a probe of Grimm's fundraising, morphing into one of the highest-profile prosecutions by the office of Brooklyn U.S. Attorney Loretta Lynch, who has since been nominated to become U.S. attorney general.

Lynch in a statement said the plea made clear that U.S. authorities "will vigorously investigate and prosecute fraud wherever we find it, and that no one is above the law."

Grimm had already generated controversy in January, when he was recorded on camera threatening to toss a reporter off a balcony and break him "in half, like a boy." He subsequently apologized.


Most citizens are denied federal employment for even minor misdemeanors on their records, let alone felony convictions...Why the fuck should any congressman/woman, regardless of party affiliation, be allowed to continue in a job that requires the trust of the citizenry being represented?

Boot his lying, cheating ass out of office...IMMEDIATELY.

The statement from Pelosi is pure partisan politics. How many other congressman have cheated on their taxes? Charlie Rangel ring a bell? Last time I checked he's still serving in congress. Either you kick out *all* tax cheats, or you let them all have the opportunity to serve out their term and leave the future up to the voters.

Either you kick out *all* tax cheats, or you let them all have the opportunity to serve out their term and leave the future up to the voters.

ANY Congresscritter who is convicted/pleads guilty to any charge greater than a traffic violation should be immediately thrown out of office.

You'll note that I DID say, "regardless of party affiliation," because, IMO, dirty is dirty...doesn't matter if they're left or right.

"We the People" SHOULD hold our elected officials to a MUCH higher standard.

By the way...since you brought up Geithner, what of what crimes was he convicted? I know he admitted to some "tax mistakes, paid the taxes, interest, and penalties...but I don't remember him actually being charged criminally...

No matter what kind of horrible crap congressmen commit, the vast majority of them get reelected over and over again.

The problem is The People, it always has been.

So what will happen to him. Probably nothing.

Meanwhile a different financial crime alleged in NY gets you choked and killed.

We reelected a governor who killed a commission looking into political corruption when it seemed his cronies were going to be in the spotlight. Convicted or plead out? You practically have to behead someone in public if you are a Democrat in NY to be investigated.

It's a christmas micracle, I completely agree and am thrilled with the candid, honest and to the point remark of Pelosi. "Clearly" is fine argument IMO given what Grimm did.


I like the toss of balcony idea as well, fitting. This kind of guy doesn't change, somebody whose committing tax fraud is going to be similar minded in office. Not that he's lacking company.

I think crime while in political office should bring charges of treason and the loss of citizenship. Makes no difference the party.

His thug behavior comes from threatening to kill a man (breaking a man in half / throwing him off a balcony is pretty lethal) - I even provided video footage.

He is an enraged lunatic.

But, you go on and justify his behavior by;
1) telling me how Democrats have threatened to kill people (or, are corrupt, because murder and corruption are totally interchangeable)
2) and how the reporter brought it upon himself,..

I don't think he has been there long enough to get one unless you combine his FBI time with his congress time. Not sure how that works, only know it from 1 side or the other, not both mixed.

I'm all for people who commit crimes to not be a part of the highest legislative body in this country. Well, the other half of me also respects the wishes of the people of his district, and allow them the ability to decide his fate, not me.

I simply cannot stand people like Pelosi who cover for their own then think they have any honor in decrying others.

Kind of like how Republicans - as part of the recent funding bill - insisted on blocking the new DC law legalizing possession and home-growing of marijuana, which had been passed by a more than 2-to-1 majority of the voters? Kind of like how the upcoming Republican-controlled Congress will leave in place federal laws blocking normalization of the U.S. relationship with Cuba, favored by 83% of Americans?

Yeah, Republicans respect the will of the people, until ideology gets in the way.
