You don't get banned from Live for installing the NXE early it isn't "pirated."

There's a disclaimer in the agreement for those in the beta that states if a friends console is system linked and updated to the NXE it won't be allowed on Live until the official release on November 19th. I have it installed, I ripped Fable 2, Fallout 3, Dead Space, and Far Cry 2 to my drive. They load ultra fast.
