NEW YORK (1010 WINS) -- Walking while texting can be dangerous -- especially when an uncovered manhole is in your path.

A Staten Island teenager -- who was walking and text-messaging at the same time -- fell into an uncovered manhole yesterday and now officials are looking into why the sewer was left unattended.

Alexa Longueira, 15, was texting while she walked along Victory Boulevard at about 5 p.m. Thursday when she plunged five feet into the open manhole.

City workers standing nearby helped to pull her out and she was taken to a local hospital, but only suffered minor injuries and checked out last night.

The family said it intends to file a lawsuit.

The Department of Environmental Protection said in a statement that crews were flushing a high-pressure sewer line at the time of the incident and that the agency is investigating the incident.

You have to be a real idiot to not watch where you are going when walking.
Lawsuit should be dismissed instantly, with a hearty laugh from the judge and everyone in the court.

Of course they are going to file a lawsuit. The girl is a dumbass for not looking while walking.

No, her parents are right to sue. I work around utilities like that and we take the time to put up cones, ribbon, folding barricades, whatever is available to us. At a bare minimum it would get three cones around it. I've worked on sewer structures 25 feet deep, the fall could be fatal.

What about the common sense of the crew who did not make that hole safe? They are supposed to be professionals. they dropped the ball big time. I'd be firing some people right now if I were in charge.

The lawsuit wouldn't be based on "our daughter is stupid and needs to be protected from herself," the issue is that the manhole was apparantly left uncovered with no indication that it was uncovered. It doesn't matter whether it was a dumb teen, a marathon runner, or the front tire of your car that went down, manholes are supposed to be marked when they're open.

I'm not going to disagree that there was negligence on behalf of the work crew. You're right, they should have put up the appropriate safety markers and barriers. However, what I'm saying is that had some basic common sense been enacted by the girl, this wouldn't have happened. Had she been actually paying attention to where she was going, she probably wouldn't have even come close to the hole.

You're totally right, and I agree with you. She'll probably win the lawsuit too. I was simply expressing my anger at the sheer stupidity of people and how they like to find scapegoats when they get injured. :p

Just don't pick the 20 foot deep one, or the one that does not have enough oxygen in it to sustain life, or..........:laugh:
