Bad enough my grampy lost his job of dumping toxic waste near homes. Damm liberals complaining about "birth defects" and "cancer".

I live in the tomato capital of the world and during canning season, the entire city smells like rotten tomatoes (the rest of the time, it smells like cow shit.)

I don't sue the dairies or the canneries because of it, because I'm not a fucking moron.

Can't say the same about the residents of this town (or you.)

Whats that can't go outside or sell your house anymore, to bad big business needs its profits.

I live in the country. I have a Hog farm about half a mile east of me. I have a cow farm about 2 miles south. I am surrounded by farmland. you know what they spray on farms in the fall? shit.

Yes the factory should try to take steps to reduce the smell. I disagree with the fact they should close.

I was ripping you for bringing up birth defects and cancer. that is a far cray from the smell burning your eyes (wich you will live through and causes no permanent damage)

Nusiance is one of the oldest common law torts. Its been around for centuries.

Fact of the matter is, in all common law countries, a person cannot come in and do something on their land that causes a nuisance(to be a nuisance it has to rise to a certain level) on another's land.

Now the dairies and cannery examples, well those probably pre-existed the residential development in your area, they have probably existed for a long time. IE: You couldn't even sue if you wanted to. You took property knowing you the property was near a cannery.

The OP is different. People owned property, manufacturer of xyz moved and causes a nusiance. They have to fix that nuisance or yes a court can order a permanent injunction shutting them down.

Folks in Modesto sued over the smell from a rendering plant. It didn't matter that the plant was there BEFORE the homes were built...they STILL WON and the plant had to close. (they fought for years and spent millions of $$ on filters and scrubbers to try to remedy the problem...but in the end, the people in the neighborhoods surrounding the plant won.

No "pollution" to any of the surrounding homes...just the stench of death.

(if you've never been near one, rendering plants stink terribly)

Same kind of thing happened near here. There was a airport outside of town. Some idiots built a houses right on the fence line. then sued because the planes were loud..WELL FUCKING DUH!

If something arises to being a public nuisance it doesn't matter how long something has existed.

This is why we have zoning laws today. Somewhere along the lines of having the sirracha plant approved by the city's zoning department, someone had to of dropped the ball/never thought about air emissions from a food processing plant.

To be very close to the chilis themselves. The owner specifically moved to California in the first place because those chilis grew there.

in denver there is a Pruina dog food plant right along I-70. I had a office about a mile from the pant and when the wind was at the right slow speed and coming from the direction of the plant. IT FUCKING STUNK!
