NOLF/W2K "can't set D3D emulation mode" a little help here

I also get the "D3D outofmemory" error in 3DMark2001. I'm using DX8A,latest VIA drivers and the 1080's(tried others too) for my Herc GTS2 Pro. Nothing in my system is overclocked and all my OpenGL games run awesome. It seems every once in awhile D3D gives me problems. When I go to oad up NOLF the screen flashes shades of black then I get the error and NOLF shuts down. I had the demo playing on this system a week ago and it was fine so I don't know what the dealyo is. I even tried reinstalling DX8A and my 1080 drivers but it didn't help. Any help would be gratly appreciated.
