I bought a 5850 with the terms for return:
This item is covered by Newegg.com's VGA Standard Return Policy.

  • Return for refund within: 30 days
  • Return for replacement within: 30 days
So if I return this(it has been opened and used), do I get charged a restocking fee, or is it a straight refund?

Restocking fee
no. they have 3 different kind of returns for video cards and the VGA Standard Return Policy does NOT have a restocking fee. now the Standard Return Policy does have a restocking fee.

when I called about returning my GTX470 which had the VGA Standard Return Policy the lady said "I will wave the restocking fee". I told her it has the VGA Standard Return Policy and she said "oh okay then there isnt a restocking fee anyway".

sounds great. Did you get free shipping as well? I've heard of newegg giving that to people before on returns, hoping I can get in on it too. I hope the GTX 460 will OC to my 5850(non reference, so I can't OC it to 5870 speeds)

free return shipping? no. if the card is defective then they probably would give free return shipping but for a return like this they probably wont.

Ugly part is they resale this stuff as new or open box

Always buy brand new sealed. Thanks
yeah for things like video cards and especially motherboards theres no way I will buy open box. theres no telling why it was sent back, could be missing stuff, and doesnt have the full warranty any longer. I have seen people save 15 bucks on mobo and then have to track down a freaking backplate or other accessories. IMO thats a stupid way to save money.
