Newegg return policy

does it not being compatible with my motherboard count as being defective? should I just lie and say its defective?

No, b/c the more people who do this put more cost on Newegg. Taken far enough, this cost could be passed onto honest customers in some way. This is assuming we are talking about you getting a refund, as newegg could no longer sell it as new. If you say it is defective, they may offer you a replacement of the same item, which still wouldn't be compatible with your MB.

Making sure RAM is compatible with your MB is your responsibility, not Newegg's.

Edit: From Newegg's FAQ: "There is a restocking fee of 15% on all returns for refund (RMA Refund), unless waived by a Customer Support Agent. We charge this 15% restocking fee for all returns for refund to encourage customers to purchase products they intend to keep. We offer RMA Replacement without any restocking fee to support customers who have received a defective product. For CPU and Memory refunds, any restocking fee we use will be a reflection on current market value for the same cpu item. Newegg.com does not support attempts to profit from CPU and Memory price fluctuations."

I would call them up. If the RAM isn't compatible b/c you ordered the wrong type, e.g. DDR when your board takes DDR2, then I would say you'd be charged the fee. If it is just that your MB doesn't like the brand that you ordered, CS might cut you a break.
 
If you can't use it because it's incompatible, it might be wise to just swallow the 15% restocking fee. =(
