New update regarding my wreck

June 23, 2004 - Insurance finally ruled on who's fault it was. It was ruled 100% the other driver's fault. The driver has the same insurance company, so I believed that was it. Unfortunately -- the driver's insurance lapsed in September of 2003. That means he is uninsured unless he received new policy with another company. So... my company is going to cover 100% of my damage at ONLY the cost of my deductible and it will NOT count against me and cannot cause my rates to rise. I have to fill out tons of information so they can pursue this guy for the money, or his insurance company if he did have new coverage. Overall it wasn't exactly what I wanted, but it is a very decent compromise instead of being stuck with a 3000 dollar bill. I've already dropped 1500 on the wreck(it will be reimbursed) and I'm looking at about another 1500 when I replace the slightly bent wheels, and a few minor body parts +labor.


Tuesday Update: Dealer said I'm basically looking at new tires all the way around. Body/chassis damage is minimal at about 500 dollars. So I'm looking at around 600 for tires, 500 for body/chassis work, and 500 a wheel if my current wheels will no longer balance. I'm on pretty good terms with the service guys, so they are busting ass to get it fixed for my brother's wedding. I rented a Toyota Corolla, and I have to say it is the most uncomfortable car EVER. My side and back is still hurting from trying to drive that little speck around. The seat room is marginal! Oh, when scooting the seat back I managed to slice my dog's leash in half as well. There goes 20 bucks right there(retractable leash).



Driving home from my Girlfriend's house and it was raining pretty decently. Going on the loop from 59 to 459 which leads to my house. Coming around the blind corner of the loop going about 35 and I see there is a massive lightpole in the road. Slam on the brakes but I was already almost on top of it. Boom! I ramp over it and I feel tires go flat. Pull it off and here comes an SUV. They nail it as well and sparks fly everywhere. There was already one car ahead of me that hit it as well. I run down to the pole, because the reason it was down is someone hit it. The guy is ok, but he's pretty scared. Pole is still live so no one is messing with it. Here comes this 18 wheeler hauling ass down the interstate, but we manage to flag him down INCHES before he hits the pole as well. He still got flats from glass though.

Other than the tires I'm not sure what damage was done to the car. The pole was a large metal one that holds lights, so it could be fairly decent damage. I was unable to look under the car, and it was towed to the Audi dealer 30 miles away. No one was hurt, and the guy did have insurance. Cops came out and did a report for me. They said he was 100% at fault, and that his insurance would have to cover it. Problem is I have to drive to my brother's wedding Friday morning, and the accident report won't be ready until Wednesday. What can I do? File with my insurance and have them get the money from his as a reimbursement? Pay it out of pocket(which honestly I don't really have right now) and get his company to pay later? I know I have one or two flats, and part of the front air dam is torn up. Sh!tty sh!tty luck for me. Flat on the interstate about a week ago, Tree about killed the car and my house yesterday, and now this crap. What the hell is going on? God has it out for me.

That's crazy man. Just a string of bad luck. So did you actually get airborne?

I was out on 121 here one time, and there's this f150 in front of me in the right lane. He seems to be falling asleep. He slowly drifts to the right, hits the rumble strip, then pulls back onto the road. I was thinking I needed to pass him when he again drifts way over to the right, but this time keeps going till he's on grass. He wakes up, swerves across to the left side of the highway into a light pole. The light pole starts to fall, I floor the gas and barely make it under before the pole slams into the ground behind me. Other cars piled into it and each other behind me.

I hope you don't have any problems w/ your car though. Get his company to cover a rental for the time being.

:( Can't find a decent rental car. Pretty much everywhere has everything rented out because of Memorial Day weekend. I've been offered a Chevy Metro, a Cavalier, and a Lincoln Town car. This sucks! I also found out the service department of the dealership is closed today. Sh!tty! I'm just going to have to get it towed somewhere else and pay out of pocket for tires, and then wait for reimbursement from the guy's insurance.

I'd take the Town Car out of those, if that makes you feel better. When it rains it pours, next week will be much better for you.

How'd you like to have a stopped car instead of a light pole around a blind corner, rear end it, be out of $3k for repairs, and be at fault? That'd be me. God hates me more than you.

I'd take the Town Car out of those, if that makes you feel better. When it rains it pours, next week will be much better for you.

Town Car = rock.

I'm either going to buy a mid-90's town car or a mid-90's crown vic/grand marquis after my 91 sable dies. They rock. Full size>dinky import. And the seats are way more comfortable.

You know that cop you met at the scene....he has no fvckin clue what hes talking about. Its not 100% because its not a clearcut proximate cause situation. There needs to be an established timeframe btwn when the first collision happened, causing the pole to fall into your path and when you actually hit the pole.

Now if the other car indicates that a period of time happened in between the two, hence a broken chain of events, there is no argument for proximate cause. Basically, you ran into a fixed object at a speed too great for conditions. Thats an at fault loss.

Secondly, as the car in front struck the pole first, even if he were deemed to be at fault for the causation of your accident, better hope his property damage limits will cover it. Most state minimums won't be enough to cover a light pole of that nature, those things are incredibly expensive. You might want to claim first party and just let them subro it. Usually your insurance company will pursue it in your favor and argue for the proximate cause.

Mill, seriously, I'm glad that it was just your car that was damaged during this incident. With the "live" wires and all, who knows how bad this could have turned out?

The driver of the car told me he was spinning the mud when I hit the pole. The estimates that we all came up with(the police, the driver, and I) was that I came along about 30 seconds after the pole hit the ground).

No, I didn't. I was actually going under the speed-limit for the ramp by a good deal. I understand what you are saying, but I can't say I agree. There is no possible way I could have stopped or that I would have hit it if he hadn't knocked it down right before I came around the blind curve. The only reason the 18-wheeler didn't hit it was because we flagged him down going into the blind curve. I think it helps that other cars did hit it as well, because to me that shows that it wasn't an individual problem.

I think it would be absurb to call it a "fixed" object, because it is obvious it isn't supposed to be there!
