Actually, that's not too much of a problem, it even puts her in a less favorable light in regards to liability. This happens all too often, but a nice little letter from me usually does the trick. Basically it says that she is personally liable for your damage and that if she carries insurance that protects her, I suggest she provide me with that information or receive a "bill" from my subrogation dept in a few weeks.
