Neighbor catches ladies cat, has it euthanized :(

WEST ISLIP, New York (AP) -- A man who didn't get along with his neighbor trapped her cat in his back yard and then took it to an animal shelter to be euthanized, police said.

Regina Fagone searched the neighborhood for two days earlier this month after her cat disappeared, and then went to the Town of Islip Animal Shelter.

Employees there broke the news to her: Her cat, a Russian blue, had been euthanized that day.

Richard DeSantis, 56, was arrested Saturday and was charged with criminal mischief, criminal possession of stolen property and making a punishable false written statement, police said. He was issued a desk appearance ticket and will be arraigned June 5.

DeSantis, reached by telephone at his home Sunday, said there are two sides to every story and then hung up.

Police said an investigation found DeSantis had captured the cat and dropped it off at the shelter to be killed.

Maybe he lured the cat over? Or maybe he went into his neighbor's yard to grab the cat and bring it into his own yard? I think there's more to the story...
 
Most courts don't care about pets. He'll probably get a slap on the wrist.

If it was mean I'd throw him in jail for 30 days for being an @ss.
 
If I were the judge I would most likely give him the maximum sentence possible. I'd also hit him with my gavel and choke slam him.
 
Russian Blues are a nasty breed of cats, if that woman didn't keep it penned up, iguarantee it was making a problem.

Right. It would be nice if the writer elaborated on how these charges were related to what he did though...something's missing here.
 
maybe they shouldnt keep their cat from wandering over to other people's property then...

though i personally dont mind and they do catch rodents from time to time and drop them at my front door step lol

Destroying someone else's property = mischief
False written statement = signing on the line at the shelter to get the cat euthanized.

Nothing missing here.

Two sides huh...sounds like a cop out. So, what pray tell do you think is missing from the story that makes it ok for the guy to have this ladies cat killed?

I just find it a bit confusing because it tends to go against the consensus in this thread. Of course, bringing a cat to a shelter to euthanize it and a dog killing it on your property are different circumstances but with the same result (cat on guy's property=dead cat)...and of course, AT isn't exactly composed of legal experts.

Except the guy didn't trap the cat and then set his dogs on it.
Nor did he deliberately kill the cat. He actually tried to save it...
In this case the cat was deliberately trapped and killed.

One is deliberate, one is accidental.
 
Why shouldn't he be allowed to trap and kill a wild animal on his own property? I don't care if it's a cat, they still can be destructive.

I've got a cat that roams at night and has scratched up my car. As soon as the opportunity presents itself, I am going to put it down. Of course, I have photo evidence of the damage. The owner claims its not their cat and refuses to pay damages.

Of course, the problem here is that it's going to be difficult to prove that he didn't go outside his own yard to catch the cat. OTOH though, it should be up to the woman to prove that the cat was properly restrained in her yard. The guy shouldn't have to prove that the cat was tresspassing.
