Need suggestions for my upgrade

Alright, so I've decided on the parts for my upcoming upgrade.

It will be:

Gigabyte GA-X38-DQ6
Corsair DDR-2 CM2X1024 8500C5 5-5-5-15

The processor will be a Penryn in early 2008, as soon as available, I will get one of the slower models (maybe a 2.4Ghz or 2.6Ghz model, or anything along those lines), but I can buy the parts above very soon (in fact I should) since I have a 10% rebate for them.

Now the questions are:

1) Is it "ok" to go with DDR-2 and X38 ?

2) The Corsair memory mentioned above is listed on Gigabyte's Supported Memory list for that specific motherboard, which is cool, but let's pretend for a moment that I just can't find anymore of that specific memory model, and let's pretend I buy something that is not on that supported list, does that mean it just won't work, or does that mean that if it ain't stable or not 100% compatible then Gigabyte holds no responsibilities about whatever could happen ?

And, overall, you guys think I'll be good with that for two or three years ? Sorry to ask, but I don't know much about hardware, except for basic OC'ing, I'm more into software stuff.

If the memory is on Gigabyte's supported list for that mobo, why not buy it now, so you'll have it. And while you're at it, buy the motherboard, too?

Nothing wrong with buying DDR2 with x38, except that x38 mobo's don't get much of a performance gain using DDR2 than the P35 boards that are available now and which are less expensive than the x38's. If you really want better performance over the P35 mobo's, you'll need a DDR3 x38 mobo to get it, but then you'll also pay the price for it.

I just put together an E6850 with an ASUS P5K-E mobo and DDR2 memory, and I expect that to last for 3-4 years, unless I get the upgrade itch earlier when DDR3 and x38 or x45 are reasonable in cost... No reason why you can't get 2-3 years out of that DQ6 and Penryn with DDR2... Then again, why wait for Penryn? The currently available Intel chips are reasonable and run circles around anything else - they'd work great with that mobo and DDR2 if you build it now :)
