Need Some Legal Advice

Heres the deal. I just had a car accident with a rental car. The thing is i think i waived the insurance thing they offered. The accident was cause by an icey road & also said by the police officer that the city will be at fault. It was a 7 car accident which i hit another car that already had hit into others cars. There was no way of avoiding it. Now my main question is what should i do ? i had no current insurance at that time as this happen yesterday at around 9:30pm est & my insurance on my new car that i just got today didnt start till 12:00pm est. It wasn't my fault as the police report will explain everything that went down once i get it. Will Enterprise try to make me pay for the damges or will the city just take car of everything. The was smashed in the front but was driveable. I wasnt hurt so i opt no to goto the hospital. Another thing the airbags on the car never poped open either.

Because when i first started the rental i had insurance which was then cancelled but then went back into effect today.

You rent a car .. choose yes for rental insurance (btw best thing ever, you can run the car off a cliff for fun and not liable) ... and it's good till you turn it back in

First off - HUH?
Second - I don't understand why you canceled your insurance policy - it should have taken effect on the new car instead of your old policy being canceled out.
 
I didnt stop my policy. My policy was cancelled for late payment. So now i just got my new car & had to pay what i owed them to get my new policy started but like i said it didnt come into effect till today 2 & a half hours before the accident. Im just asking questions here since my local enterprise branch is closed & my insurance agent is closed also. I wont be able to contact any of them till Monday.

Will Enterprise try to sue me if i refused to pay them for something that wasnt my fault ? & if they do can i just take it up with the city since they was the ones who where at fault ? i'm thinking of sueing the city as im getting some bad back & necks pains & will be going to the doctors first thing monday morning. Only reason i have yet to goto the ER is because i got no type of health insurance the that ER bill will be outta control. Im also thinking about taking action on Enterprise themselfs as i wanna know why in the hell with such a hard impact the airbags didnt come out. To be honest im thinking the airbags in the car wasnt/doesnt function right. I know they get tons of defected cars all the time.
 
so what if the car was stolen instead? that's not really your fault, but you're sure as hell responsible.

did you put the entire rental bill on a credit card? now, go ahead and see if your credit card has the rental car coverage. the insurance they offer is damages to the car, not the liability.

sure, blame everyone else for your own sh!tty driving. airbags only deploy in very specific circumstances. I don't have any sympathy for you, you're an idiot for driving without insurance.
 
I don't understand how it's not your fault... How is the city responsible for you not leaving enough room in front of you?

Edit: and the cop should have written you a ticket for driving without insurance
 
Most Visa/MC/Amex have rental insurace already on it, assuming you rented a typical car (i.e. no exotics). The CC insurance is secondary but if you have no auto insurance in place, then the coverage becomes primary.

I don't know about the US, but over here in the UK it's illegal to drive without insurance.

What kind of insurance company do you have that doesn't at least have someone that you can talk to 24/7? I'll be sure to never recommend a company like that to any friends - USAA for life! 🙂

If you didn't have insurance, you can be expecting to pay for the damages out of YOUR pocket. I can't figure out why you would turn down their insurance when you know you don't have any sodding insurance for the time being. You'd better do some serious thanking that the cop didn't cite you for driving without insurance (and hope that you didn't lie to the cop and say that you did have insurance when you didn't).

How fast were you going at the time of the accident (going too fast is way too obvious and wouldn't count)? Most newer airbag systems, IIRC, are set to not deploy under a certain speed due to relatively minor fender benders setting them off (<10mph).

As far as medical expenses go, expect to pay those costs out of your pockets at least for the time being. You might be able to go after the city to recoup the costs, but consider yourself lucky if they do pay for your medical expenses.

Oh well, hopefully you learned to be a bit more careful when driving on ice tonight (and yes, I've had to drive on ice before, so I know how bad it can be).
 
Well, I'm still going through the claims process for my VISA auto rental insurance, but it looks like I should be okay. It's part of the benefits to the card, so check and see if you have similar protection. If it was a debit card, then no, probably not.

And the rental company has the minimum insurance required by the state, so there would be no reason to give the OP a ticket.

There's a good chance he (or his cc insurance if applicable) will not have to pay anything if it is someone else's fault. Their insurance will be the first in line to pay.
