Need some Ebay claim advice

Hello everyone,

I need some help with an ebay issue that I'm having. I recently purchased two Canon 580 ex ii flashes from ebay with the buy it now method. I received the first one from a seller and it was in great condition. I received the second one today from a different seller and holy crap, it's in horrible condition. It was dirty (not that I mind, I can always clean it up) but the side button that controls the Pan/tilt of the flash head is completely busted open (it's a rubber material, but missing half the rubber so all you see is the exposed mechanics underneath). Also, there is a little diffuser "garage door" on the top of the flash that can come out and help diffuse the light. Well, this "garage door" is COMPLETELY missing, and you can see a spring in the flash where it should be. Also, one of the ports is completely ajar, meaning someone moved the flash while a cable was plugged into it and it damaged the port. It probably still works, but still, it's broken in my eyes.

So the user had this thing marked as used, and never said a damn thing about ANY of these issues, plus the pictures didn't show any of the damage.. basically the user was just trying to fuck someone out of their money by not showing the damage to the item.

I just processed a claim, but of course the seller "doesn't accept returns" so I messaged him and I am trying to resolve the issue by being civil. If he says no, what are my options? I know ebay says if I don't get a resolution in 4 days then they will make the final decision. Should I just contact my credit card company and tell them I got screwed on the deal? Or maybe paypal? I purchased through paypal with my credit card. I just want to know what you guys recommend and what you have done in the past, as I'm sure some of you have experienced this type of thing.

File a claim for item not as described and let Ebay/Paypal take care of it would be your best bet

Not sure if they still do but Paypal used to ban your account if you filed a chargeback through a cc without going through them first
 
What was the item description rating?

Also, if he won't accept a refund, just file a claim stating "Item not as described."
 
I would first file a claim through eBay. If you describe the damage was not documented, they will refund you after you've sent the item back (they give you a spot to enter the tracking number and will refund shipping costs). Once the item is marked as delivered, you get your money back.

If they don't side with you , your next bet is to file a charge back from the CC and let them sort it out. Your PayPal account will be most likely be closed, held, or banned and good luck using eBay again with that account. But, you will get your money back.

Thanks for the info, that's good to know! I guess I will wait and see what ebay says. Hopefully the guy is just an ass and doesn't respond and ebay sides with me. Or if he responds he complies with a return and refund and doesn't try to put me through hoops or be dishonest the items condition.

Not sure what you mean by description rating, but it was marked as used like this:

And here was his description: Speedlite 580EX II shoe mount flash for Canon. Used. Works well.

Yeah, the flash fires and everything, but the used condition states "some signs of cosmetic wear, but is fully operational and functions as intended." Obviously Canon put the garage door diffuser there so people could use it to diffuse light, so in my mind it is not functioning as intended by Canon.

Thanks for the info.. It would suck having my paypal account shut down, but it would suck even more to have a piece of crap in exchange for $300. That would be nice to be refunded. I trust ebay will do the right thing since they have been in business for so many years.
 
Under eBay's listing policies, you have to specifically mention if an item doesn't work according to specifications. That's why you see so many listings "for parts".

If he didn't mention it was broke, its implied it worked. Your claim should be easy

Thank you for the reassurance, I certainly hope so. I can even take really nice pictures of the working one I have right next to it for proof!
 
Item not as described dispute and call it a day. Keep tabs on deadlines and escalate escalate escalate.
 
Ok well, that was pretty quick. The seller got back to me and said they were selling it for a friend and didn't know the condition of the pieces I mentioned. He said he would gladly refund the money as soon as I shipped it back to him.

At this point I need to figure out how to proceed. I just want to be careful I don't get screwed and I've never had to ship something back before. Do I ship the item back to him and put the tracking number through ebay so they can keep track of the claim?

I would formally open up a dispute if you haven't already - these fields are present when you use the official form. You can open the item not described dispute and go through the process without truly escalating it.

I would also email the seller and give him a heads up that you're doing this as a CYA measure. There is no negative to the seller.

Once the claim is in your favor, there will be a place to enter it in on that claim. After you do that, when the item gets to it's destination, you get your money refunded. If the seller decides they want to be slick and complete scumbags and remove all funds and sources of funds from their PayPal, you still get a refund and their account goes negative. PayPal / eBay goes after them for that, and you get your money back.
 
You're the buyer. You're OK. You could probably curse him out, keep the item and accuse of not shipping it and you would get your money back.
