Need some divorce advice...

Just got off the phone with my mom, who is in the middle of a divorce.

Apparently, my stepdad has been claiming everything as personal property since the beginning of their marriage. So now she's screwed.


I don't know alot about divorce and claims, but just wanted to see what you think and any advice you might offer. She only makes $1,400/month.

I have some experience in family law. I need several questions answered:

1. what state were the married in?
2. what state do they live in now?
3. what state is the property located?
4. do they own a house? If so, when was it purchased?
5. IS THERE A PRENUP?

Everything obtained prior to the marriage can generally be claimed as personal. Anything obtained after the point of marriage up until a legal seperation is usually marital property this split 50/50.

Doesnt matter if she never bought a thing and he bought it all she could be entitled to half. Thats what my lawyer has essentially told me through my divorce tho I am not in your state so this is all just general guidelines.
