I gave my car 18days ago for re-painting/ dent removal/ and some other body to be performed. He gave me a verbal agreement that the work will be completed in 14days. (i know). His form was pretty simple. I filled out my info, he wrote what work will be performed at agreed price, and I wrote myself on there the due date per agreement. I signed at the bottom to give him authorization for repair and they will be not held responsible for any items missing from the car.

Now it's 4days overdue. He still has not completed and what bothers me personally is that my parents has had to make sacrifice and be without a rental car outside of the agreement. and we had to make re-arrangements to be without of a car and it has put some of a burden now.

What rights do I have. Specifically, I want to re-negotiate on the price for simple inconvenience (because I have agreed to pay him very well upon completion) he has caused and has delayed the delivery of my car twice. How should I go about this and what would you do if you were in my shoes? I have not paid him yet.

I need your professional advice.

I would have gotten that in writing with the stipulation that rental-car charges of $xx.xx per day would be deducted.

You're up the road without a wheel. Seriously, this is purely a negotiation between you and the shop owner. In small claims court, you would have to prove you suffered actual damages from his not returning your car when promised. That does NOT mean money you chose to spend due to sacrifice or inconvenience.

Your parents should buy another car if they had to make sacrifices due to this issue. There is cheap and there is outright inefficiency

It doesn't really matter when he said he's going to have it done if there's nothing written in the contract about what happens when the delivery date is missed.

Thought I ask. Thank you guys.

I have patience, I don't want to come of rude, but I would have appreciated if he finished the work on time.

This shop is small business, has good rep from community and been featured on magazine. From the good feedback I read and pictures of his work, I based my decision on that.

You're right I do not want to rush him and do an half-ass job. I love my car. :D

Just on top of my head, what would happen if i layed $200 less on the table, and do I have the right to take my car out? hah

You would still owe the remainder of the bill. You do have the right to take your car out but, you would still owe the remainder of the bill. The small shop would have a very easy time winning in small claims court.

You don't want a lien on the car. Playing around with autoshops can be messy business.
