Need serious advice... friend just got caught, what to do?

Okay, this is gonna sound like it's about me, but it really IS about my friend.

In any case, I would appreciate any advice from anyone that knows of situations like this one.

Okay, so my friend got put on probation last semester for smoking pot in a dorm room. He got a fine, and had to do community service. Well, yesterday he's just sitting in his room and the two RC's knock on the door, he opens it, they come in and say...

"We were told by a confidential informant that you have illegal substances in here, and so we're gonna search your room. You can give us anything you have now, because we're still gonna find it."

So my friend is basically screwed already, so he gets his pot out of his drawer and hands it to him, and told him about his various paraphenalia in the room. This is his second time being caught in the year, and I'm afraid he's gonna be kicked out of the school.. This is the univ of miami, btw.

Flash forward to today... still havent' gotten a call about anything. Haven't heard anything about what's going on, but my friend tried to go visit the dean of students, but he was gone today... what should he do? Does he have much of a chance? Any thoughts?

Oh, and before anyone says this:

YES, it was STUPID for him to smoke in his dorm... he is seriously pissed at himself. He's already said that no matter what happens he can't smoke anymore... he can't risk it.

I'd say he's boned...and a complete moron. Sorry, but I dont' think there's any good advice to help you out the second time you get caught for something like that.

Here at Purdue his ass would have been out of the dorms after the first instance.

Sounds like your friend better get a lawyer.

Your friend is a dumbass who was given a second chance and screwed it up. It is his problem, let him deal with it as he is getting what he deserves.

The thing is... he wasn't being sketchy about it... someone just had a problem with him and said something, or at least that's what the RC's said... they wouldn't give a name... isn't that required though?

They weren't real RC's, they just smoked out and laughed at him for handing over all his stuff. They same people will probably be back when they need more to do another search.

I would recommend actually reading my post, because if you did you would've read and understood that I am his friend, not just some random jerk. I don't care how many times he screws up and does stupid stuff, he's my friend firstly, and so I'm always gonna try to help him.

Your friend sounds like he doesn't belong in college, if he's too stupid to give up the drugs after being put on probation.

He could agree to go into some drug rehab / treatment program, that might be enough in our victim cultrure.

Note that I'm not passing judgement on the drug use itself, just the idiocy of continuing it under his circumstances.

Nah, he knows one of the people that came in was definately the RC, because he met her before.

Do they even have the right to search his room without some type of search warrant? They aren't police and they don't have a search warrant. I would have told them to go fsck themselves.

I got kicked out of the dorms for just BEING in a room where there was a party going on. They pinned it on me (it wasn't) and out I went.
Welcome to the real world......

I did read yolur post.....your friend is a DUMBASS and deserves what he gets. You cannot help him no matter how much you would like to and I appreciate your concern but stay out of it or you could get dragged into the mess. He chose his path, let him deal with the consequences.

He is prepared to deal with the punishment, but he wants to try to at least see if he can get community service, go to some classes, take regularly scheduled drug tests while on probation, etc.... he just doesn't want to get kicked out, because then he won't be able to transfer either (at least easily).

Uhm, he'll probable be kicked out this semester. :(

Since universities get all PC (polewhacky correct), he could go first to the drug treatment clinic at the school hospital and apply for drug awareness treatment. DO IT TODAY BEFORE THEY CLOSE! Then go to the dean of students and claim addiction while currently seeking treatment while at school.
;)

If they kick him out he'll lose the program and go deeper into addiction. Yeah, that's the ticket.


They key is to show not only repentance but actively taking part in rehab.

What school is this?

I worked in Residence Life, and we were not allowed to just walk into a room suspected of having pot or whatever. We needed "probable cause" similar to real cops, and we had to have real cops with us. On more than one occasion, we knew who was smoking and where, but the police officer that showed up could not be 100% certain which room it was coming from and we could not do a thing.

We would never have been allowed to just bang down your door and demand you hand anything over, and we were not permitted to look anywhere not in plain view, and we were definitely not permitted to handle "evidence."

Maybe being a state school we had real rules to conform to, but it sounds like something shady definitely happened to you....er....your friend.

First off I would try to find out who that informant is.
Not to hurt him or anything, but I wouldn't want to be hanging out
with anyone who might turn your ass in for doing something wrong.
And if they know he as pot, is someone he probably knows, unless he
advertises it to the school.

I would definitely find out what is going to happen. Some schools
treat things differently. He might get a semester suspension, a year,
or expelled. I would bet on some type of suspension and maybe
another punishment, like no longer able to live in campus residences.
But you never know.
