My Dad got in a car accident and it was 100% the other guys fault. His insurance company requested that we take the car to their adjuster for inspection which we did. They estimated it to be around $600 for all the repairs using used parts.
Its a 1993 Dodge Spirit with 100K miles, so I really don't mind the used parts, but I got three other estimates that were in the $1300 range. They sent us the check for the $600 and it says total payment on the check, so if I cash this they are off the hook. I would prefer to get the cash (not repair the car) and put it down on a diff car for him, but how do I get the insurance company to pay me what the real damages are? I can't get them to budge. What are my rights in this situation? I appreciate any advise you can give me or personal experience. thanks

I think you have the right to use new parts on your car.. but you have to be careful because if you want them to give you the new parts repair cost it might total out the car. What is the value of the car? I cant see it being worth all that much.

When I got into an accident I just said that my repairs will cost $3,400, but you only cut me $2,250. I had to complain, the body shop fax over estimates for repairs, call my agent daily (uninsured motorist crash), and basically raise hell for more cash. You take their first offer, you usually get screwed. In CA, you can choose your own shop, which I did.

Just a guess, but wouldn't you want to sue the guy in small claims court, and when you win (assuming you do) his insurance company should pay the rest. Just a guess, not official legal advice.
