Not only that, but I bet you don't have permission to use that picture of the AlienWare PC (why would AlienWare want people building their own PCs?), and probably not all those background images, but I'll give you the benefit of the doubt on those.

Don't take it personally. This is not a case of the big company pushing on the little guy because they want to screw you. They have to defend their trademark. If they don't defend it in this situation, then a big guy could abuse it and point to your case as reference. It is part of their responsibility to protect it which is why they are talking to you. They are being as cordial as can be expected given the circumstances. It is probably best to either request compensation for the time you can't use the domain (your $10 fee or whatever) or just give it up.

Given all that, I agree it sucks. Such is life.

They had something about this on CNBC yesterday. Company called Federal Espresso was sued by fed ex. Fed ex lost. Coffee shop made a blend called charbucks, starbucks sued and lost. They listed a few more examples and all the big companies lost.

They said something about likelyhood of confusion. So I guess if you have the money to fight them in court, you may stand a chance.

well there is a diffrence. a company called dederal expresso is a coffee shop. not many people are going to expect them to ship a package.

with the coffe shop thats a blend. while iffy i can see why starbucks lost.

but the OP is doing a "how to" sight for people with limited knowledge. wich is what the fordummies does also. so yeah i think the OP would lose.
