Need help resolving a trade dispute **CLOSED FOR NOW, COME BACK FOR UPDATE IN A WEEK**

So, I bought an ipod from a seller here, here's the thread

In this thread, he states that the ipod is hardly used, in mint condition, with no scratches at all. "as new as can be," he says.

i get the ipod, and wtf, there are plenty of scratches all over the front and the back. there's no way this is in mint condition.

After asking him why there are scratches on the ipod, he says. " The
"scratches" can be removed using any polish.  They are mostly from fingerprints or as a result of being in a protective case. "

Yet, he claimed in his thread that there were NO scratches whatsoever.

And then he tries to direct to me some sites about removing the scratches:

I purchased the IPOD in January, and I barely used it. Its in MINT condition, absolutely no scratches, not even any marks on the sliver back.

He definitely spewing false information. If you decide to return it, he should refund you all the way. Trying to con CompUSA or Postal Services to take the blame for it is bordering a troll's action imo. One more to add to the DNT list.

Make sure you leave apropriate heatware. Ask for a refund.

Ask for refund. Quote his claim that it was mint condition, and point out that he obviously lied. If he balks, ruin his online trading reputation by posting a thread here (any anywhere else he does business) and by posting a negative at heatware. Not much else you can do.

He says: "Well if you want you can return it and i will refund your MO."
I told him:

"If I were to return it to you, you'd have to pay me back:

the cost of shipping it back to you - 7.10
price of the ipod - 170
cost of shipping to mo to you - 4.30
cost of the mo - $1 "

He responds:

"You get your MO back thats it.  You could of looked at the pictures that I offered to anyone on request.  You did not ask for it.  I
gave you what I believed as a IPOD in great condition.  I have tried to be honest with you and work with you in this matter.  I can
just ignore all your messages and take your money.  But I am not that kind of person.  The IPOD works, in great conditon and comes
with everything that should come with it.  I will not pay for your shipping nor refund you your shipping.  This is my final offer."

Ok, so now he's threatening ME. I believe he owes me for the cost of shipping it back to him, the cost of shipping the mo to him, and the cost of the mo...


More advice is needed..... should I enlist the help of the troll hunters?

Take the money order and forget the shipping. If you push it, it is likely you get nothing back. Make sure he mails the mo back to you first, though. After you get the mo, mail the ipod back to him, then leave a negative at heatware and post in his sale thread that the ipod is not in mint condition and that traders should be wary of dealing with him. He loses more in the long run that way.

Is the screen so scratched as to be unreadable? If it is then yes go the fraud route.

Send his recommendation that you commit mail fraud to the Postal Inspection Service, that oughtta make for a fun evening :)

dont buy used stuff. I buy used stuff only if it dirt cheap and i expect it to be in bad condition. buy new or refurbished from reputable stores

Ok how bout this:

I give him three options.

Option #1: I enlist the help of the troll hunters to contact the postal inspection service and report his fraud.
Option #2: I ask him to give me monetary compensation to buy the products necessary to get rid of the scratches
Option #3: full refund, based on my original terms

what do you think?

hearing just your side of the story and assuming everything so far is accurate, I think any of those three options are not only fair but generous.

I think mint condition can mean different things, in sellers opinion it was and is in mint condition few minor scratches is mint condition, if product been used for some time, you can expect it

MaDDinGO and I had a very rough trade a couple months back...I actually had to PM the mods to get a response from him....him ignoring messages sounds pretty familiar

Except he explicitly states:

Which means ABSOLUTELY NO scratches. There's no allowance there for a few minor dings.
