Need help identifying tree

All,

I need to figure out what kind of tree this is and I haven't the slightest idea - I'm not a plant person. Anyways, I have a dog in the backyard and want to make sure the berries won't make him sick. The funny thing is, we've had this house for 2 years and this is the first time I've seen berries on it.

You need to specify where you are, what the habitat is etc. Looks like you live in the desert?
 
Whatever it is, it isn't native to the Sonoran Desert. Probably an asian import. Ask your developer. Better yet, kill it and plant a palo verde or mesquite in its place. Better still, kill your developer and plant a palo verde or mesquite over his grave. Have to discourage the planting of exotics.

Good call, I'm in Tucson, AZ - sorry I didn't include it in the original post. It is very common here but I don't know what it is.
