Need help! I got a court summon

HI, guys

I got a ticket for driving 96mph at a 65mph speed limit zone in Indiana this Month. The worse thing is that they sent me a court summon and charged me reckless driving, a class B misdemeanor. Is there any chance for me not to have to appear in the court? I am afraid that they will put me in jail if I show at that time. If I don't appear in the court, they will issue a warrant of arrest. The problem is that I come from another state, can they arrest me via the police in our state?
Thanks for your kind help. Any suggestion is welcome.

if you don't show up for your date, the judge can issue a bench warrant, and if the police pick you up in the state you live in, they and the agency in indiana would have to decide whether or not they want to transport you. you better find a way to get to court.

Of course they can arrest you, it's only another state, not even another country.

I have the same problem, 60 in a 35. I my state, Missouri, I think you can sign a wavier of right to trial and just pay the fine. (its on the back of the ticket) I am not complety sure, it varies state to state. In Missouri a class B misdemeanor the max fine is $500.

yes... there should be a way to just sign a waiver to sign away yer rights... of course this makes you pay the max fine.. thats why the state sent you the summons.. they know u wont show up

I don't know about the fine/penalty, but I did want to say "SLOW THE HELL DOWN!!!" Geez, what business do you have driving that fast. Hope they take away your license, too.

In fact, there was no fines in the ticket. And what I get is only a court summon. I called the court and they said I must show up at that time. I don't know how to waive my right and just send them the money.

It's a trick! Don't show up to court, they can't do anything. If you do decide to go, make sure and tell the judge he is stupid first thing. Just so he knows how you feel about the judicial system. It will get you points for being honest.

Show up and plead your case. You will get fined but that amount will be drastically reduced if you kiss a little judicial ass.
Don't do the crime if you can't do the time.:cool:

The cop clocked me @ 60, myself and 3 other people in the car say, 50. Which I can't really argue in court. The road was 45mph but changed to 35mph, which I didn't know because its not my area of town...

Isn't there a law to prevent the police from camping so many feet after the sign?

Just go, you're screwed, and talk to a lawyer, you may actually get out of this with no fine, no jail...long shot, but it beat state pound me in the @ss prison...

Lookie here also My state does not share that stuff with other states so you might check on that. But if you do not pay and a bench warrant is issued they will not try and bring you back but you better not go back to indiana.

Thanks, dude. I went to the traffic court yesterday and told the judge exactly as your advice. He was shocked at first, but then he thanked me for telling the truth and let me go with just a warning! hehehe...

You should go to court and plead your case. You will get arrested if you fail to appear.
When you're in court, ask for the judge's mercy by B.S.ing something like you were in emergency to help out your friend or family member. Try to be as reasonable and logical as possible, otherwise, it's getting worse. Ask your friend or family member to be there with you, just in case the judge might want to verify.
For regular case of speeding, you'll have 4 choices (in Calif): guilty, not guilty, no contest, traffic school.
Not Guilty: If you think the officer made mistake. You'll be given another court date with the presense of the officer who gave you ticket.
Guilty: admit your fault and pay the fine (usually very cheap). It'll apprear on your DMV record.
No Contest: you don't admit nor deny your fault and pay the fine (usually very cheap). It'll apprear on your DMV record.
Traffic School: Pay regular fine and take a traffic shool course. Won't show on your DMV record. But you can take one every 18 months.

If you're not sure, you should contact a lawyer to ask about your situation. In most cases, it's free of charge to answer your question.

In many states, driving > 20MPH over the limit is considered reckless driving and many of those states require you to appear in court for those. Also, many states have reciprocal agreements with other ones (and almost always neighboring states) - if you don't appear, not only will a bench warrant be issued, but your state may revoke your license.

That really sucks man, I just got through that myself. I was doin 85 in a 55 down rt. 460 in virginia and a cop nailed me. The judge basically said "Drop your pants, lube up, bend over, and prepare for penetration"

Ended up with a $500 fine, that was most of the cash I've been able to save up recently:(

I never denied speeding. Being clocked @ 60 rather than 50 is the difference between a class C misdemeanor and a class B misdemeanor.

Plead not guolty, and then at your next court date, show up, after you've grown a beard and put on 40lbs, and have the judge make the officer pick you out of the court room, if he can't positively identify you....you're FREE!!!
