Need Ebay Transaction advice

Ok, I need some advice on what I need to do with this.

March 10 - I buy some JL Audio Speakers on ebay. For some reason I think I have enough time to gut my entire car's sound system. After I find out that I don't have enough time I put them back up on ebay using the same text that the guy I bought them from used. I never even took them out of the box or anything.

April 12 - Auction ended for My JL 6 1/2" Speakers, guy pays I ship out.

April 17 - He emails me asking if they were new. I emailed back and told him that I bought them off ebay and used the same text as the last guy, and if there is any problem with them I will take them back. He emails back "the rubber butyl surrounding the cone just seems kinda worn, and there is quite a bit of dust on the cones/inside of box. I guess I was under the impression they were BRAND New, but that may have been my mistake." No more communication until..

June 01 - He sends this email: "Dude, I just finally got these speakers hooked up and one of them is totally fvcked up. When I depress my accelerator it makes this awful whinning noise as if it is blown or something, anyway I have to buy new ones. I'm willing to send them back to you so you can determine exactly what is wrong with it, but I would like my money back or equal replacements for them. Please let me know your course of action regarding this matter. I don't want to involve ebay but will if necessary. I have already had a problem with an amp I purchased off ebay and this guy would not respond to me, so I filed a case with ebay's fraud department. He's no longer to sell anything on ebay!"

I am not sure what I should do in this situation. I never tested the item, so shame on me. The problem here is the problem he mentioned sounds to be more related to his amp rather than the speakers. I did look at the speakers while I had them and they looked solid.

Any thoughts, suggestions, rude comments? 😛
 
Did you auction claim that the speakers worked, or were they sold "as is." If you claim them to be new and working, then I think your stuck, unless you can prove that his claims are false.

I would at least get back to him and tell him that you will let him know what needs to be done within the week. That way he at least knows you are not avoiding him. His problem does sound like he wired something wrong, though.
 
don't mess with eBay...protect yourself, send him back his refund, but try to negotiate a deal where you send maybe 75% of his money back for his not testing the speakers right after he bought them...

if he doesn't wanna do that send him the full refund
 
Show us the text you posted. As long as it did not say they were new you should be okay. Plus you sold them in April. He did not complain until June. The only place that takes stuff back after that long is Walmart.
 
Speaker advice: If they're going fine until he depresses the accelerator, he messed up a wire somewhere or his amp is messed up.

Ebay advice: He had them for a month and a half before he got back to you. Implied return period is no more than 14 days. How do you know that he didn't mess them up himself in the time he had them? You didn't test before sending them to someone else. He didn't test in a reasonable ammount of time. Shame on both of you, but you got out of it ok. He's just gonna get the shaft on that one.

And when you email him back tell him he's an asshat for threatening you in email in his first letter to you instead of being nice and trying to work out the problem.

and I just remembered, he paid me before auction was closed and he did not go through ebay. I cancelled the auction.

Then there is nothing he can do. Ebay will tell the guy to go fsck himself since he didn't go through ebay and as such they didn't get the transaction fee. Which is what I'd tell the guy to go do also, since he was such an ass in the first place.

Actually, no, refund him $0.01 and send it paypal so the paypal fee wipes out the actual currency 😀
 
so they're "like new" and have never been used, which implies they've been opened, maybe touched, but never installed...hmm anyone have any thoughts?
 
There was never a bid on it, so his threat of going to Ebay is a hollow one. Once Ebay is taken out of the picture, they will do nothing. The fees they get pay for their time to investigate fraud and disputes. Tell him he should have used BIN, and then he would have a case.
