need advice (riaa?) update (it was p2p)

My cable connection was disconnected since 2pm this afternoon.
I have called Adelphia (my isp).
The tech transferred me to abuse department.
Now, I was worried since I was using p2p (emule).
But, 99% of my download was anime and I thought RIAA don't care about anime.
Anyway, after 30 minute holding, I hung up.
I guess I have to call the abuse dept tomorrow.
(They are closed now.)

Anyone had similar experience?
Should I burn my hard drive and cdrs?

I have called their abuse dept.
Followings are what he said:
My account was suspended because I used file sharing program.
When Adelphia receive a complain they have to suspend me.
He couldn?t tell me who actually complained.
I will receive a certified letter with complain.
This is the first warning and he is going to put me back online.
He recommended stop using such p2p program all together since sharing copyrighted material is federal offence.
 
I did not think the ISP cared how much or what you are downloading unless subpeoned by higher authority, ie the government. They do get pissed if you uncap your line though.

EDIT: Although i really think you should send your HD's to me for proper....umm.....destruction. 😉

most cable isp's have a daily download limit. maybe you just downloaded that much?

This would be my guess. If you had emule running 24/7 then you are in violation of Adelphia's service contract (IIRC, it's been a while since I was an Adelphia customer). The Abuse Department would be handling people abusing the system, they would not be handling complaints from the RIAA or the MPAA.
 
I did not uncap.
I don't think it's the daily limit.
I have downloaded more yesterday than today.
I don't know they even have the limit.
 
Some ISP's have monthly limits, however I would never in my right mind to business with any ISP with time/bandwidth limits. :disgust:

Unfortunately, they do not have the link to their TOS online. When I was a customer they used to have a clause that basically stated that even though the service is available 24/7 you were not allowed to use it 24/7. Basically you have to get in touch with their Abuse Department. Your account might just be suspended until you contact them so they can give you a warning. Of course, if you continue to abuse the system (according to what they say is abuse), then your account will be terminated.
 
So, if it is not RIAA and just bandwidth abuse,
what should I tell them tomorrow?

Promise never to use p2p?
Promise use p2p for 4hr/day?

Would I be forgiven?

When you get in touch with them they should tell you why your account was suspended (you shouldn't have to tell them anything, other than to ask why your account was suspended. If they ask why you use so much bandwidth, make up a story). If they say you are using too much bandwidth then just make sure to close down your p2p program periodically to give the bandwidth usage a rest. If they say the RIAA lawyers are on their way to your house, run.
 
its nothing.. Adelphia is just run by a bunch of idiots... i have had them for over 3 years and i havent had any problemes with usage

Actually, while it looks like it was just Adelphia busting your balls, it could be worse. I've heard that the MPAA/RIAA have been sending letters to isp's of people who have been using p2p clients to download/upload copyrighted material. These people immediately lose their isp accounts.
 
The thing is I was sharing fansubbed Japanese Anime.
I thought MPAA/RIAA don't have the copyrights for them.
I thought I was safe untile Japanese people come after me.
I guess I was wrong.

The day my ISP cancels my account just for using P2P software without proof of transferring copyrighted material is the day I cancel my account and find another ISP.

My ISP should not dictate what software I use.

The letters say the person was transferring copyrighted material. Odds are the RIAA/MPAA has proof against these people who the isps get letters for.
 
I looks like Adelphia don't need proof.
Under DMCA, if someone complain, they say they have to suspend me.
I have to wait until I get the letter to find out who complained.

By the way, it is either Adelphia or no cable.
I don't have choice.
 
is it for uploading or downloading material? i can see where they can get you for uploading (ie, being a server), but can they tell if your downloading RIAA material?

Anyway, I noticed a new line in my cable modem status.

It says "Initialize Baseline Privacy Skipped"
Does that mean they are determined to monitor anything I transfer now?
It wasn't there before.....

Yeah sounds like they are watching you, but I'm not exactly sure... I'd call them up and see WTF is going on...
