Need advice re: car towed by apartment building. *FINAL UPDATE*

We were away this week. Got home to find one of the car's towed. It was in a normal parking spot. Reason is they re-paved everything here and we were not here to get their note about moving the vehicle. The note was left on the 27th sometime that day saying that the cars all had to be moved by the 29th at 8am (actually 28th if in a different bunch of buildings). I have yet to read through the very long lease, but does anybdoy here think I have a chance of getting my money back either through asking or sueing? I hate this fvcking management and I have lots of time, so yes sueing is worth it to me.

Two weeks I can understand, but 48 hours is in my opinion ridiculous. It was in fact less than 48 hours.

EDIT: How do I find out? Their emergency personel on duty now have no idea. I'm not calling 911 and regular police station is closed. Who do you call to find out who towed a vehicle?

*UPDATE* Well I spoke to somebody at the office and the car was towed with others to the back of the property. I just picked it up. No storage obviously but she said there would be a towing fee. I dunno how much. Guessing under $100, which is great for me. The reason being I'm going to now write a letter to the manager asking her if it's worth alienating residents over such a small fee (is it worth Skoorb bitching over $100? I bitch on ATOT for free - what do you think? 😛). My lease is up in two months and I'll make that clear in the letter and state also in a passive threatening manner that I know other people here and that I may contact their head office if I have to.

The sub-manager I just spoke to indicated we had 24 hours notice and I was adament that we did not have a full 24 hours notice. If that's a sticking point I'll get freaking witnesses. Oh well on the plus the sentra was not in a strange place with strange cars around her and I'm not out of pocket a few hundred bucks in the meantime.

*FINAL UPDATE* Well I wrote an effective letter and dropped it off at the office for the manager to read Tuesday morning. Later that day got a message on the answering machine saying she understands my point and she is waiving the towing fee because of my vacation. Others still have to pay. I've written three such letters in the past to various people like this and gym memberships and I'm three for three getting what I want 😀
 
Man, I'd be pissssssed. I would definately fight it.

I'd be surprised if you were the only one.. Maybe you can find others that had the same thing happen, and go as a group. That would probably be quite intimidating. 😉

Don't know yet so I'm gonna read. If I didn't what is the law likely to allow in this sort of matter? Our lease is up in two months and obviously I'm not renewing - even if we don't get our house; we'll move.
 
I HATE my apt's management too. Before it was first come first serve parking.. then they decided to make it numbered. So on the night before it was supposed to go into effect, some stupid girl had my car towed. I was so pissed because i had a contract that said it didn't go into effect until midnight. So i paid to have the car dropped (they didn't pull it out of the parking lot yet, so it cost $50) and then deducted it from rent. Told them to piss off, since it was illegally towed. Wasn't part of the contract. THEN later they towed my truck because they didn't see the damn parking permit. Again i saw them before they pulled out and i made them drop it. This time i didn't pay them a bloody cent. THEN later they cut at a tree and it falls on my truck and it was a pain in the ass to get them to pay me for it. finally got $3000 from them. bastards....
 
How much do they charge to tow there? Its $70 here in Gainesville, which is bad enough for a college town. Those assholes even sued the city to try and get them to double it to $140 so that they could pay for ATM's all over the city, since they only take cash.
 
the town towed my car where i go to school for teh same reason. parked on a sunday they put up notices on monday. car was towed on teusday. no effort was made to contact me or the school about it. i paied my towing fine but DIDNT pay the 150 parking ticket i got along with it. my mom handled that and gave teh PD a thing or 2

OK all my lease says about parking is that they need to give 24 hours notice to tow a vehicle if it's being involved in a repair on premises (mine wasn't).

Then there is a part about they can tow if it has a flat tire, expired license/tag, takes up more than one space, or doesn't belong to the resident.

BTW they gave this notice after 2:00 tuesday when we left and they were going to start towing the first cars the next day at 8am. I'm so fvcking mad with this place. It's 9:00 and I have to go get my car so that I don't keep paying storage costs. Plus the sow of a management bitch can't spell for beans. Their golf cart was stolen a while back and on the notice to hundreds of residents she said it was "Stilled". Freaking imbecile.

I wish they were open now. God damn it.
 
Man...sorry to hear that Skoorb, but I don't know if there's anything to be done. If you say you have the time and energy to go about the legal route, then good luck...I have a good management company, so when I had my car towed (at fvcking 5AM...I look out the window, no car), it was a mistake, and the company yelled at the towing company since they were still told to not tow anybody. The fine for me was $148.

But yeah, that's crazy, less than 48 hours...hell, if I was at a good party, I might be out for the expanse of two days, let alone the fact that you were on vacation. Tell them that if they need information spread that fast, use a fvcking *gasp* phone or something...at least that way you could've informed them that you were out of town and to leave your car there.

If all else fails, lookup tow or towing in the yellow pages, have your license plate and VIN number handy and start calling.

Replace "Bouncer" with Skoorb and "Patrick Swayze" with "ATOT" and there ya go. Lots of good suggestions here on finding your car, and after you do, politely explain the situation to management. Be nice until it's time to not be nice. 😉
 
To find your car:

1. The Apartment complex desk should have a tow log where the tow company left a receipt for the tow.

2. Call the local police departments (NON-EMERGENCY), desk number. That should be easy to find. I find it hard to believe that your police department doesn't have a 24 hour desk. Police departments never close.

Ask them to look in thier tow log for your car.

 
Usually complexes have a deal with a certain tow company. See if you can find any of those signs that say "your car will be towed blahblah".. and see if it has a number or company name.
 
Can't you report your car being stolen? Likewise, dont you have to file a police report anyway, do you?

Sorry about that skoorb, i hope you get your car and money back.
 
damn, I just wanted to say that sucks and I'm sorry it happened to you. Good luck with getting your car back and not having to pay any of the fees.

Sueing? It will cost you more in time and money to go to court than to just forget about it.
Complain to them in person and in letters.
If they say no, then just drop it and consider yourself a victim of circumstance.
