Almost a month ago I put a Gameboy Advance up for sale on ebay...the winning bidder sent the money MINUS the shipping charges. I told her she has to finish paying me, and a few days ago I get an email saying she doesn't want it anymore since it's too late (she still never finished paying). I told her i'd refund the money MINUS ebay and billpoint fees, and now she says she's going to have her attorney get into touch with me (she was a real b*tch to boot, got all the emails).

Anyway, she has pretty sh*tty feedback, and ruined my almost-perfect feedback -- would I have to worry about this attorney crap even though i'm not even at fault?

Here's the old auction: http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=1342028828

pffft. whats the lawyer going to do? if anything she'll pay the attorneys more than what she paid you for the gameboy.

my advice: you cant reason with stupid people on ebay who cant read. lord knows i've tried. hold your ground and offer to make a refund minus fees. youre the one who didnt make a mistake, why should you have to pay for it?

I'm gonna get my lawyer on you, have you heard of Johnny Cochrane = standard internet response from stupid 13 year olds. Just ignore it.

Especially since what you're keeping for yourself is only a few bucks, maybe 3-4 dollars. The person (if they really had a lawyer) would be charged that much just for thinking the lawyers name.

I'm with ThaGrandCow on this one. Chances are, she doesn't have a lawyer and is just bluffing.

You're in the clear. Ugh... It pisses me off that every internet n00b thinks they can sue anyone.

Refund the money minus the fees she cost you, give her your phone number, and patiently wait for that call from her attorney. I guarantee that call will never come.

Reply to the Neg-feedback with what you told us, that she didn't pay you the agreed amount, so you didn't ship, and instead gave her a refund minus the fees she cost you.

that's why I never let people with zero/negative feedback bid on my items.

I would refund her the money minus ALL fees you have had to pay.

The best thing to do is go here, and request a fee refund for a non-paying bidder. I agree, you are in the right, and she deserves to pay your fees. But eBay refunds them anyway, so why go through the hassle of dealing with her?

looks like she WAS bluffing about her attorney (her "attorney" was that SquareTrade online thing..)

I just got this email from her:

I have contacted the Better Business Bureau and have learned that you are in the wrong. They have notified me of my rights and because E-bay and you e-mailed me with a GRAND total of $60.00 plus shipping/handling fees, which I have saved those e-mails, you are required to refund my $60.00 in total. I have also filed charges with E-bay regarding you. You did not tell me about the extra money until I already paid for the merchandise. You my friend, are a shark!!!!!!!!!!!!!!!!!!
Bethany Flanagan

I can't believe how dense she is...she claimed the GBA was for her son, so the fact that she was old enough to have a child would imply she should have at least half a brain...

whats ebay gonna do? "see item for shipping charges" "add $8 for shipping"

i dont see where you went wrong. BTW, she even admits to $60 plus shipping. How much did she send you then?

You've got nothing to worry about (aside from having to deal with this moron). Best plan of action: be clear, concise and stick to the facts. Let her get as angry as she wants, you've got all the leverage here. There might be a chance (albeit small) that she'll realize what she did wrong here.

<< Winning bid please add $ 8.00 for shipping and handling via insured priority mail. >>

Plain as day in your clean item description. edit: All the purple italic text at the bottom is butt ugly ;)

What's the BBB got to do with anything? I don't think she has a clue. Even if you were a business AND registered with the BBB, there's nothing they would do about it except file a report in their circular file.....

<< They have notified me of my rights and because E-bay and you e-mailed me with a GRAND total of $60.00 plus shipping/handling fees >>

Apparently she can't add, either.......$60.00 PLUS $8.00 shipping handling fees adds up to $68.00 according to my calculator.....

Personally, I'd refund everything but the insertions fees, file non-paying bidder alert, then apply for final fee credits to get the rest back.
