NE1 work for human resources?

My dad was sick for over a year and passed away last month. I was living with him and taking care of him for the whole time and towards the end it was too much for me to work as well. So starting Dec 7 '06 I took family leave from work. Dad died on Dec. 20th '06. Before I left to bury my father where he asked me to, I got in touch with my boss on Dec 27th '06 and told him that I was going away for two weeks and why. He was fine with giving me another month leave to Feb 7 '07 and said that he would request my leave to be extended another month with HR and the medical insurance company.

I got back last night and there were like 7 messages from him on my cell and home number. That I was to call him right away. So I did. My boss found out right after I left that from human rescources that "family leave" is only valid while the aling family member was alive. That they can give me a week of berevement pay and cover me for the additional days and that I need to go back to work next week! I told him that I was not ready to go back and needed the extra time to Feb 7th. I asked him if he could change the famliy leave wordage to personal leave with HR. He told me he will find out by Wedensday and not to come in on Tues. They never got another guy to cover my shift and the two other guys are probably sick and tired of covering the 12 hours between them everyday.

Is family leave only in effect until the family member is still alive?
I wanted to take an additional month off as well. Family leave has a max of 12 weeks.

I got the forms in the mail from my medical insurance company (cigna). Family leave is extended every month and I need to get a social worker or doctor to fill in and sign off on a section of the form. Am I in danger of losing my job and medical coverage now?

Yes. Your only option is to have Personal Leave approved by your boss and HR department.

On another note, sorry to hear about your loss.
 
FMLA only does cover til the family member dies, and I believe that's nationwide although some states may have specific laws. Sounds like you do have bereavement time off, and a week is pretty standard. Your boss is being a good guy in getting stuff covered for you.

Ask about taking a sabbatical, use up your paid time off bank or request unpaid time off. The company has given you what they're required to, and it sounds like they've been pretty accomodating about going beyond as well. It doesn't sound like you're in danger of losing your job or medical coverage, but you're not going to be able to get additional FMLA leave.
