NCsoft is being sued for making Lineage II "Too Addictive."

I think the judge needs to be sued for wasting taxpayer dollars, and the idiot bringing the suit to be thrown in jail for a month or two.

NCsoft of South Korea is facing some major trouble as a gamer of their MMORPG Lineage II has filed a negligence suit against them, which a federal judge has allowed to proceed.

The addicted gamer/plaintiff is Craig Smallwood, and he is seeking redress because of the addictive nature of the game, resulting to him being "unable to function independently in usual daily activities such as getting up, getting dressed, bathing or communicating with family and friends."


According to Smallwood, he has spent some 20,000 hours from 2004 to 2009 just playing Lineage II. Because it got him hooked so bad, he is now asking for an unspecified amount of money as damages from NCsoft.


He also alleged that NCsoft "acted negligently in failing to warn or instruct or adequately warn or instruct plaintiff and other players of Lineage II of its dangerous and defective characteristics, and of the safe and proper method of using the game." Had he known that the game would be that addicting, he said he wouldn't have touched it in the first place.

The judge handling the case, U.S. District Judge Alan Kay gave out a ruling earlier this month, making it possible for the case to proceed to trial: "In light of plaintiff's allegations, the court finds that plaintiff has stated a claim for both negligence and gross negligence."


NCsoft is not immediately available for comment on the ruling, but has already filed an appeal to the judge for the dismissal of the case.


Earlier this year, back in February, NCsoft opened Lineage II absolutely free for two whole weeks.

Seriously, what kind of arguement does this man have?

I guess in a legal sense, a computer game is like a drug (thinking tobacco and alcohol here) and thus has addictive properties which could lead to it being detrimental to someones health. Tobacco and Alcohol now carry warnings about the health risks or the addictiveness of such consumables. Even gambling carries a warning to 'gamble responsibly' and the industry has a certain amount of responsibilty in that.

In reality, where most of us live except for those few hours where we would like to relax and choose a computer game as our relaxing tool, we would not consider sueing a company because we felt 'addicted' to it. We'd just put it down and walk away... (or sell the WoW account :p)

Another case of law gone mad I think.

With this affliction, it's surprising he could come up with the motivation and will to follow through with filing this case.

I'm guessing his wife pushed him in to it. (l@@ks at name...) I mean his mom...

honestly even if this does go to trial all NCsoft has to do is get ONE drug expert to explain the difference between physical and psychological dependence and the case will more than likely be dismissed.



it's kind of insulting that this judge doesn't seem to comprehend this.

Well, they did have to create the word flammable because inflammable caused people to believe it was invulnerable to fire and wouldn't become inflamed.

Serious gamers can spend hours in front of their favorite games, but would they consider themselves addicts? Craig Smallwood certainly does, and he has sued NCsoft, maker of Lineage II, for failing to warn him and other users that the game is highly addictive.

Hawaii-resident Smallwood played Lineage II for more than 20,000 hours between 2004 and 2009, during which time he became "psychologically dependent and addicted" to the game, according to court filings posted by Wired.

NCsoft, however, "never gave [Smallwood] any notice or warning of the danger of psychological dependence or addiction from continued play," according to the case.

A Hawaii judge recently threw out some of Smallwood's claims, but refused to dismiss the entire case, and let it proceed on claims of negligence, gross negligence, and negligent infliction of emotional distress.

It appears that Smallwood's case centers not only on his alleged addiction to Lineage II but on NCsoft's marketing strategy.

According to Smallwood, he was locked out Lineage II in September 2009, despite having paid for an additional 1.5 months of game play. A month later, NCsoft said it locked Smallwood out because he had participated in "an elaborate scheme to create real money transfers." Smallwood denied the charges, and said NCsoft's real motive was to get users locked out of Lineage II so they would upgrade to its new release, Aion.


Smallwood also accused game moderators, known as Game Masters, of not effectively policing Lineage II, and instating "banning purges" intended to "promote Aion and increase their profits."

NCsoft did not immediately respond to a request for comment, but in court documents, the company confirmed that Smallwood was locked out of his multiple accounts over allegations of real money transfers, which are prohibited by the game's terms of service.

Apparently the new game, Aion, doesn't do it for Smallwood. He said "he continues to this day to have a compulsive urge and need to play Lineage II." He has also suffered "extreme and serious emotional distress and depression, he has been unable to function independently, he has suffered psychological trauma, he was hospitalized, and he requires treatment and therapy three times a week," court documents said.


The judge threw out all the claims relating to "addiction" and let the lawsuit proceed over claims that the defendant used deceptive practices (fraudulent bans) to coerce people into playing Aion instead.
