The victim was not in the car. The car was the only thing damaged. Sure EG was admittedly drunk. Sure he was allegedly pulling his pud, while he was allegedly watching porn.
Taking all of that as the gospel truth, why sue the guy? What is the real injury?
It looks like a simple property damage case which may have been filed for the purposes of shaking down EG.
I'm applying Texas law here. Minnesota law may be different. Does anyone know if the tort Negligent Infliction of Emotional Distress exists in MN? It does not in Texas.
