As far as your 'Constitution' argument, it doesn't make sense either.. Does the Constitution prevent people from protesting a mosque being built? Does the Constitution prevent people from believing and saying that its INAPPROPRIATE to build a mosque where they are? Nobody is saying its illegal (Its not).. We are asking for the same SENSITIVITY toward the victims of 9/11 and their families that we are constantly asked for by Muslim's when we are in THEIR communities.
Your strawman of legality aside, I don't consider "appropriateness" to factor in at all when contemplating the motives of a political faction that's already pimped 9/11 out for political gain and specious talking points. If the site for the mosque was next door or directly on top of ground zero, you might have a point. You're just relying on an appeal to emotion as usual, facts be damned.
