i would return it as well.. besides that, it will be noted by your bosses and in the future could help you w/ a promotion or something.. just the fact that you were honest..

Yes things are slightly different, but my point was that it isn't his money, and in some (all?) states the work can legally claim it back.

give it back... they will catch it eventually. My previous employee overpaid me by $20k over the the course of a year on comission checks. I (honestly I swear to Christ) never noticed it as it was spread out so much over the course of each paycheck. Our comission rates were so difficulty to figure out and I was well over quota so that screwed up all the multipliers even more.

So the year end awards come and I and my boss are expecting me (and him for that matter) to be awarded. They do an audit on any quota award winners and BLAMMO! They found out they they screwed up and the problem only grew and grew as the year passed... so what do they do? Dock my comission until I recoup that $20k.

POINT IT OUT NOW... its the right thing to do (if/when you notice it) and they WILL find out eventually.

Definitely give it back, if for no other reason because it's from your employer. If they found out they overpaid you and you just kept it, it will reflect very poorly on you.
